CC - Alternative Compliance Kimley>>>Horn January 10, 2022 City of Meridian Planning Division Community Development 33 E Broadway Ave, Suite 102 Meridian, Idaho 83642 RE: Oakwind Estates Phase 1—Noise Abatement Alternative Compliance Dear Planning Staff, The Oaks Build to Rent LLC is applying for final plat approval of Oakwind Estates Subdivision Phase 1. As part of the Phase 1 Construction Plans, per the City of Meridian Staff Report, noise abatement is required for the subdivision frontage along McDermott Rd. The proposed construction for the noise abatement is a 4 ft tall berm in combination with 6 ft tall fence. The fence is Simtek® Ashland® style product by CertainTeed. It is composed of steel reinforced polyethylene fence panels and posts. It has an STC 26 rating according to ASTM E 90 Sound Transmission Loss Test. The fence has been approved as a noise abatement alternative by the City of Meridian through coordination and submittal by Toll Brothers. Phase 1 of the subdivision has approximately 1,230 linear feet of frontage along McDermott Road and proposes 1,166 linear feet of noise abatement fence. Less fence than frontage is proposed due to subdivision pathway connections to McDermott Rd and existing easements. Alternative Compliance is required by the City of Meridian UDC as the proposed installation does not conform with UDC section 11-3H-4.D.1.c.2. Section 11-3H-4.D.1.c.2 states "the wall shall be staggered every three hundred (300) linear feet subject to subsection (D)(3)B of this section that prohibits breaks in the wall." Construction of the Simtek®Ashland@)noise abatement fence is not intended for staggering as described in the UDC. It is proposed the construction of the noise abatement fence is linear without staggering. This construction will be similar to the vinyl fencing proposed for the rest of the subdivision and the existing adjacent road frontages for Oaks North and Oaks South developments. The "Red Cedar" color option has been chosen for this subdivision. Below are pictures of the proposed noise abatement fence. Kimley>>> Horn _ r. 41� �•., ,. . r e This request meets the requirements of UDC 11-5B-5.B.2 regarding the conditions when alternative compliance are allowed; specifically condition "(f) Additional environmental quality improvements would result from the alternative compliance." The additional environmental quality improvements by granting this alternative compliance request are: • Aesthetically pleasing nature of the fence and how the fence will blend with proposed landscaping and adjacent the existing adjacent subdivision developments. The proposed fence meets the noise abating needs of the subdivision and is more aesthetically pleasing than a traditional concrete or modular block noise abatement wall, even one that is staggered per City of Meridian Code. Additionally, the red cedar color and slatted appearance style will blend better with the proposed landscaping within the McDermott Rd landscaped buffer.
