Please find enclosed revised drawings. Itemized response to comments dated January 7, 2022:
General Comments:
1. The City requires a legal description & exhibit map per AZ & any accompanying RZ's. Also, the legal
description needs to extend to any adjacent roadways, which in this case would be the railway
centerline to the south.
• A legal description has been created for annexation and rezoning. It extends to the centerline of
Union Pacific Railroad. Annexation and Rezoning Exhibits have been updated to reflect this.
2. Affidavit of Legal Interest is not complete. In addition, documentation needs to be provided showing
Mr. Hessing's involvement with the noted owner on the new Deed. Then, the Affidavit should be from
Mr. Hessing to whoever is submitting the application.
• Affidavit has been completed.
3. The Narrative describes the proposed road as a private road but no private street application was
submitted. Staff would not support this as a private street development anyways. Please confirm your
intent with this. - That being said, if the proposed road is indeed a public road, it cannot be located in
its own lot and will be deeded to ACHD with the plat. The Common Drive should be on a common lot
but not the public road. - Common Drive - No more than 3 homes can take access off of the same side
of a common drive per our new standards and it appears you are showing 4. Please verify.
• The narrative and preliminary plat have been updated. There is no proposed private road, only a
common drive that will provide access to lots 6, 7, and 8. Lot 5 will be accessed from the public
road, not the common drive. The public road has been removed from Lot 13.
