I guess there is the option for a variance, but I don’t know how you would be able to make a finding that the variance is not as a result of a self-created hardship that deprives him from enjoying the property in the same method as the neighbors. A use or activity that is incidental and secondary to the principal use and is conducted upon the same property.” Not sure if I could give you an actual percentage. This means the self-storage would have to be the primary use, with more square footage than the outdoor RV storage. If you are not going to rezone to I-L, let me know soon because we’ll have to continue and re-notice for a different hearing. You are proposing to rezone to I-L. This is because I-L and I-H allow outdoor storage as a principally permitted use, otherwise, it can only be allowed in C-G as an accessory use to indoor storage and is required to go through conditional use permit. The I-L zoning district requires a 35’ street setback from ultimate right-of-way (look at Footnote Number One at the bottom of table 11-2C-3.) W. Nelis Dr / N. Burley Ave is shown as a local road, which has a ultimate right of way of 47 feet (based on their technical manual). This means from centerline you would measure 23.5 feet, and the setback would be measured 35’ from that. Based on your site plan, I’m not sure you meet this. This may be a pretty big issue if you cannot provide me information that the design as shown meets this setback.
