Dear Mr. Thornton:
This letter is to confirm that the Director approved your Certificate of Zoning Compliance
Change of Use application for a restaurant on the subject property, zoned C-C (Community
Business District). The proposed use is subject to all previous conditions of approval associated
with this site (RZ-11-006; VAR-13-001; MDA-14-008, DA #2014-088001; PP-14-011; FP-14-
041; CZC A-2019-0292).
The restaurant encompasses 1,950 square feet of the 6,450 square foot retail building. The co-
tenant (Liquor Store) currently occupies the remaining 4,500 square feet. The recently approved
Certificate of Zoning Compliance (A-2019-0292) for this site includes thirty-three (33) parking
stalls to accommodate both tenants. Note: No exterior modifications are approved with this
application.
This approval is subject to compliance with UDC 11-4-3-49, Restaurant:
A. Parking:
1. At a minimum, one parking space shall be provided for every two hundred fifty (250)
square feet of gross floor area.
Upon any change of use for an existing building or tenant space, a detailed parking plan shall
be submitted that identifies the available parking for the overall site that complies with the
requirements of this title. (Ord. 19-1833, 7-9-2019)

The applicant, Director, or a party of record may request City Council review of a decision of the
Director. All requests for review shall be filed in writing with the Planning Division of the
Community Development Department on or before September 24, within fifteen (15) days after
the written decision is issued, and contain the information listed in Unified Development Code
(UDC) 11-5A-6B.
If City Council review of the decision is not requested, the action of the Director represents a
final decision on a land use application. You have the right to request a regulatory taking
analysis under Idaho Code 67-8003.
