Subject:RE: Oasis/The Dalton Royal Please do The Right Thing
Hi Bonnie,
Thank you for taking time to talk with me tonight on the phone and sharing your additional thoughts on the Dalton
Royal application and my response to Marlin Brown from last week. I appreciate your comments and hope I was able to
confirm the appeal process that exists for this current application. I also appreciate you sharing your concerns about
possible pedestrian traffic with this application, and your concerns over potential impacts of traffic and parking at
Champions Park.
Under Unified Development Code (UDC) 11-5A-4, any person who wants to be a party of record with regard to the CZCU
can request so in writing. A party of record may seek City Council review of the administrative decision on or before
November 1, 2021, within fifteen (15) days after the written decision was issued, pay the $692 application fee, and
include a written basis of appeal based on and citing the information listed in UDC 11-5A-6B. I know this may not be the
process that you want the project to follow, and hopefully it provides you the necessary information for how to pursue it
further if you chose.
I have added the City Clerk to this email so that your email and comments are added to the public record, and again, I
appreciate you reaching out and sharing your concerns.
Sincerely,
Dave Miles | Chief of Staff

Mayor Simison, and City Council,
1
As we sat through the City Council hearing on the Oasis, for hours and hours, I wondered how it had
gotten this far -- why it was not stopped within P&Z -- and what steps would be taken to ensure that
citizens would not ever again need to hire attorneys, raise money to purchase signs, etc., for "the
right thing" to be done.
For all the reasons raised at the hearing -- the lack of parking spaces -- where the overflow parking
would likely go -- the problems of overflow parking going to the commercial lots on the other three
corners with pedestrian traffic through that intersection back to the Oasis -- and pedestrian traffic in
the dark when some may have been drinking, to return to their vehicles -- and the large traffic after a
concert or large wedding pouring out into the intersection with the neon light warning against right
turns on red -- his stated purpose to bring large concerts to Meridian -- and the volume of customers
needed to cover those expenses --
Yet, here we are again, with the same proponent wanting to place his business on the same corner,
under a different name with a different stated intent...
...and we are told the City is helpless unless citizens complain and file an Appeal?
There is something wrong with this. PLEASE do the right thing.

Hi Marlin,
Thank you for reaching out regarding your thoughts on the Dalton Royal application. Your email has been received by the
Mayor’s office and I appreciate your detailed items. As your email suggests, this project has been submitted to the
Planning department and there is a potential for this to be heard by the Mayor and Council as the application has an
appeal process. If an appeal is filed, that is when the Council could take the item up. While the appeal period is currently
open, the Mayor and council should not be providing input. I believe the City Clerk has responded to your inquiry as well,
and I wanted to make sure you had the complete information in case you did not receive any communication.
We have contacted our Planning Department and they shared that the proposed use is for a restaurant and indoor
recreation facility as you noted, both principally permitted uses in the C-G (General Retail and Service Commercial
2
District) zoning district. The property has been annexed and zoned C-G since 2005 when it was part of the Sadie Creek
Commons commercial subdivision.
Understanding the preceding Oasis application was denied by City Council, the currently proposed uses are principally
permitted which means they only require administrative, staff level review. There is no public hearing for administrative
th
applications. On October 15, City Staff issued a Certificate of Zoning Compliance, Change of Use approval (CZCU-2021-
0016) for a restaurant/indoor recreation facility use for the tenant space. This is a different use than the previously
proposed Oasis nightclub which was a Drinking Establishment. The use of a restaurant/indoor recreation facility on this
site is consistent with the existing Development Agreement.
Under Unified Development Code (UDC) 11-5A-4, any person who wants to be a party of record with regard to the CZCU
can request so in writing. A party of record may seek City Council review of the administrative decision on or before

I have added the City Clerk to this email so that your email and comments are added to the public record, and again, I
appreciate you reaching out and sharing your concerns. Please also feel free to reach out to Bill Parsons, the Planning
Supervisor, who can also address any further questions you may have.

De ar Mayor and City Council members,
It has come to my attention that the person/group that was proposing to open a nightclub on the corner of
Ustic and Eagle Rd called “The Oasis” is now proposing to open this establish under a new name “The
Dalton Royal” even though the previous nightclub was rejected by the Meridian City Council due to
overwhelming objections from area residents and businesses. Even though I am not a resident of
Meridian, I live just on the other side of Eagle Rd in Boise. This is not an appropriate area for a
nightclub, even one rebranded as a “restaurant”. Please protect our kids and grandkids from the
havoc such an establishment would generate. Let the proprietor find a location away from
residential areas.
Sincerely,
Marlin Brown
