Your email has been received by the Mayor’s office and I appreciate your detailed items. As you note, this project has been submitted to the Planning department and there is a potential for this to be heard by the Mayor and Council as the application does have an appeal process. To your email request, the appeal process is the action on how this would come before City Council. If an appeal is filed, that is when the Council could take the item up. While the appeal period is currently open, the Mayor and council should not be providing input. I believe the City Clerk has responded to your inquiry as well, and I wanted to make sure you had the complete information in case you did not receive any communication. We have contacted our Planning Department and they shared that the proposed use is for a restaurant and indoor recreation facility as you noted, both principally permitted uses in the C-G (General Retail and Service Commercial District) zoning district. The property has been annexed and zoned C-G since 2005 when it was part of the Sadie Creek Commons commercial subdivision. Understanding the preceding Oasis application was denied by City Council, the currently proposed uses are principally permitted which means they only require administrative, staff level review. There is no public hearing for administrative th applications. On October 15, City Staff issued a Certificate of Zoning Compliance, Change of Use approval (CZCU-2021- 0016) for a restaurant/indoor recreation facility use for the tenant space. This is a different use than the previously proposed Oasis nightclub which was a Drinking Establishment. The use of a restaurant/indoor recreation facility on this site is consistent with the existing Development Agreement. Under Unified Development Code (UDC) 11-5A-4, any person who wants to be a party of record with regard to the CZCU can request so in writing. A party of record may seek City Council review of the administrative decision on or before November 1, 2021, within fifteen (15) days after the written decision was issued, pay the $692 application fee, and include a written basis of appeal based on and citing the information listed in UDC 11-5A-6B. I have added the City Clerk to this email so that your email and comments are added to the public record, and again, I appreciate you reaching out and sharing your concerns. Sent from Mail for Windows 2 Meridian City Council Member Meridian, ID 83642 Lorraine Reinhardt 1716 E Summercove Ct Meridian, ID 83646 October 21, 2021 Dear City Council Member, It has come to my attention that The Dalton Royal Restaurant to be located at 3085 E Ustick Road was approved by the Director who gave a Certificate of Zoning Compliance Verification. This project is on the site of the previously denied Oasis Club. The Oasis club was vigorously protested and you as a City Council unanimously voted to deny the application. I realize this is not the same application but I take exception when another “route” has been discovered to get approval for an establishment that has many of the same characteristics as the Oasis. The Dalton Royal Restaurant has the same applicant, Mr. Tsai, who has primarily stated the venue will be a restaurant with social gathering events and alcohol. Hours of operation are late afternoon into the night. Capacity at this time is 200-300. I believe the community needs an opportunity for hearings, which allows for our opinion to be heard, and this decision making should be a higher priority than the Director. The City council can intervene and stop the process to move it back to full Planning and Zoning and City Council approvals. I ask as my City Council member that you please stop this approval and intervene. For your information, I live in Meridian, live approximately 1 mile from this proposed site and want to continue to live here peacefully in my retirement years. To tell you how strongly I feel about this issue, I am at home recovering from Covid (yes, I am vaccinated), yet I am taking time and strength to write this.
