Caleb, I am hoping this can be rectified and we get put back on the Nov 4 hearing. Our narrative was simply stating the
legal acreage of the associated parcels, while the annexation acreage is Meridian’s requirement to include the acreage
to the centerline of Hwy 84 and Black Cat right-of-way. This project and the associated escrows can’t afford a two week
delay based on the difference of IDT and ACHD ROW acreage vs the real project acreage that the public cares about in
the first place. Any help here would be greatly appreciated. Please advise.

Meetings are both virtual and in-person.
Unfortunately, I have much worse news.
When I scheduled this for hearing, I sent out a project description based on the acreage that was provided in your
narrative and the online submittal through the portal – 122 acres +/-.
While writing the staff report, I analyzed the annexation legal description and found it to be 130.2 acres. I should have
used this for the project description.
I asked the Clerks to update the project description for the hearing. They noted they would have to re-notify based on
this. I conferred with staff and legal about whether this was necessary given the addresses, parcel numbers, and the
vicinity map were correct. Unfortunately, it was decided that the wrong acreage is a big deal and it has to be re-

noticed. It will have to be rescheduled for November 16.

Just an update on today’s development review meeting.
All in attendance were recommending denial on this project. We have already discussed the issues at length, but here is
a re-cap:
Use
1. Your narrative repeatedly analyzes industrial and the market for it. The plan recommends mixed employment and
low density employment there. Although “light industrial” is listed as one of the uses in regard to manufacturing, the
type of industrial that allows warehousing and distribution as a principal use is designated for the industrial area to
the west. Warehouse / distribution is specifically mentioned as a use appropriate in the industrial category of the

ten mile plan. Your plan as submitted suggests this being built out as a warehouse / distribution facility. We believe
ME is appropriate there, not I-L.
2. What the concept plan shows is not the intensification and integrated mixed use employment discussed by the plan
in this area.
3. Although a traffic study is not required with an annexation, the finding regarding whether it is in the best interest of
the City is. With several million square feet of industrial uses being proposed, the number of loading docks that
would generate truck traffic, and a large amount of land already entitled for development directly across Black Cat,
staff believes there will be significant traffic impacts that should be analyzed.
4. The plan intends some 20,000 jobs, especially in this area. With the amount of development already built and
entitled, we do not believe the project as shown will produce a large amount of high -end jobs.
5. We appreciate the offer for a fire station, but this would not reduce any impact fees. Also, the City could request a
dedication anyway, or not support a proposed development in this area if there were not satisfactory fire service.
6. Although the narrative suggests incubation and numerous tenant spaces, there are no safeguards to prevent this
from building out as warehousing / distribution.
Design
7. The plan does say 1-4 stores in ME, but the intent is not for ALL of the buildings to be one story. Your elevations
suggest all those buildings being one-story, which is indicative of warehousing and distribution.
8. There are specific street sections shown in the Ten Mile Plan for multi-modal streets, whereas this network has been
designed for easy access for delivery and does not meet those sections.
9. The plan shows a north / south connection whereas one is not shown.
10. You have requested deviations from design standards but have not offered alternatives for the same or better
design.
11. The Ten Mile Crossing development is an example of the kind of design and development envisioned for this area.
We do not believe what you have submitted is consistent with this vision.
12. The Plan says larger buildings should be broken up or wrapped in smaller buildings, whereas this is not shown.
