I. PROJECT DESCRIPTION
The applicant, Thom Whitworth, requests Certificate of Zoning Compliance (CZC) approval to:
1) cease the vehicle sales or rental use from the subject property as previously approved with
application CZC-08-054, 2) continue the vehicle repair, major and minor use on the property located
on 0.28 acres of land in the I-L zoning district, and 3) install landscaping and site improvements as
shown on the site/landscape plan attached hereto as Exhibit A.
II. DECISION
The City of Meridian Planning Division hereby issues this Certificate of Zoning Compliance for
vehicle repair, major and minor, at the above-named location, subject to the conditions listed in this
report. The site/landscape plan prepared by T.A. Whitworth, Architect, on September 27, 2021,
labeled A0-0, as shown in Exhibit A, is approved. CZC-04-075 and CZC-08-054 are superseded by
this CZC, and are no longer in effect.
Note: This is not a building permit or certificate of occupancy. Please contact Building Services at
(208) 887-2211 to verify if you need a building permit and/or certificate of occupancy. If you do
need a building permit or certificate of occupancy, you must complete that process before you
commence the use or any construction. Please contact Building Services for additional details
about building permits and certificates of occupancy.
A. Site Specific Conditions of Approval
Use of the property for minor and major vehicle repair shall comply in all respects with each and all
of the following conditions:
1. Any and all inoperable or dismantled motor vehicles that are repaired, awaiting repair, or
otherwise used at the location shall be stored behind a 6-foot closed vision fence, wall, or

screen, or within an enclosed structure, and shall not be visible from the street. Inoperable or
dismantled motor vehicles shall not be stored or parked on public rights-of-way. Inoperable or
dismantled motor vehicles shall not be stored or parked in the designated parking areas.
2. Auto parts, inoperable or dismantled vehicles, and recreational vehicles shall be screened by, and
shall not be visible above, the 6-foot enclosed fence.
3. The alley may not be used for vehicle parking or storage of forklift(s) or other equipment.
4. The trash bins will be rolled out into the alley every Tuesday night and then moved back behind
the fence after Wednesday morning pick-up.
5. Vehicle sales are prohibited at this property.
6. The property owner shall construct all fencing shown on the site/landscape plan, and/or any
fencing required by the UDC. The specifications, construction, and maintenance of any and all
fencing shall comply with the standards as set forth in UDC 11-3A-7 and 11-3A-6B.
7. The property owner shall remove or relocate any existing structures that do not conform to
setbacks and/or use in the zone.
8. No signs are approved with this application. Prior to installing any signs on the property, the
property owner shall submit a sign permit application consistent with the standards in UDC
Chapter 3 Article D and receive approval for such signs.
9. The property owner shall install all landscaping and bring the site into conformance with the
approved site/landscape plan.
10. The approved site/landscape plan may not be altered without prior written approval of the City of
Meridian Planning Division.
11. Upon installation of the landscaping and prior to inspection by Planning Division staff, the
property owner shall provide to the Planning Division a written certificate of completion as set
forth in UDC section 11-3B-14A.
12. The property owner shall complete all required improvements prior to use or occupancy of any
building on the site. It is unlawful to use or occupy any building or structure until the Building
Official has issued a Certificate of Occupancy.
B. General Conditions of Approval
Use of the property for minor and major vehicle repair shall comply in all respects with each and all
of the following conditions:
1. The property owner shall have the continuing obligation to provide irrigation that meets the
standards as set forth in UDC 11-3B-6 and to install and maintain all landscaping as set forth in
UDC 11-3B-5, UDC 11-3B-13 and UDC 11-3B-14.
2. The property owner shall comply with the outdoor storage as an accessory use standards as set
forth in UDC 11-3A-14.
3. The issuance of this CZC does not release the property owner from the requirements of any other
permits required or issued for the site.
4. The property owner shall have an ongoing obligation to prune all trees to a minimum height of
six feet above the ground or sidewalk surface to afford greater visibility of the area.
5. The property owner has a continuing obligation to comply with the outdoor lighting provisions as
set forth in UDC 11-3A-11.
6. The property owner shall have an ongoing obligation to maintain all landscaping and constructed
features outside of the clear vision triangle consistent with the standards in UDC 11-3A-3.
7. The property owner shall have the continuing obligation to meet the specific use standards
for vehicle repair, major and minor as set forth in UDC 11-4-3-37 as noted above.

III. CITY COUNCIL REVIEW
This issuance of this CZC is a decision of the Director. The applicant or a party of record may
request City Council review of a decision of the Director. All requests for review shall be filed in
writing with the Planning Division on or before October 26, 2021, within fifteen (15) days after the
written decision is issued, and shall contain the information listed in UDC section 11-5A-7(B).
If City Council review of the decision is not requested, the action of the Director represents a final
decision on a land use application. You have the right to request a regulatory taking analysis under
Idaho Code section 67-8003.
