Joe:
Thank you for your follow up for the DA Mod Hearing with Meridian City Council next Thursday.
It is the intent of the applicant to leave the plat as it was approved on Dec. 22, 2020 - see attached. The
applicant will move the old access easement so that it is centered on the centerline of the new public road
access approved with the attached plat.
Thank you!

Hi Penelope,
Just to follow up on this.
I am glad the plat will not change as it works, it really does. Since the request to modify the DA came from you,
the Applicant, can you provide what you now propose to do with the easement area? The City cannot propose
something until you do. I hope that makes sense. Technically I need to get something to Council by the end of
the day tomorrow.
Let me know if you need anything from me!

Joe:
As always you have laser focus!
The plat that we finalized with - the one that doesn't show any changes to the SW corner like the exhibits I
provided for the first DA Mod hearing, will be the plat that will stay in place. The SW corner will remain open
space with the sewer and water and it will have curb gutter and sidewalk.
Thanks Joe!

I guess it depends on what the owner would like to do. Leaving the plat as-is is rule #1 here. If the owner
intends to move the easement per the letter from the attorney, revising the requested modifications to the DA
provisions should only be necessary. Visually showing anything is not hard to imagine if the easement is being
moved to go over the public road. I will also send these items to Bill Nary as well. I am sure Council will be
asking his legal opinion.

Penelope,
I see your point there. I like email because it is in writing and can be reviewed and responded to appropriately
as time permits. Phone calls can lead to brash answers that may be incorrect or have to be walked back, in my
experience.
Thank you. I definitely do not feel like myself this week. Getting another Covid test today to hopefully confirm I
do not have Covid.

Thanks for the email. I will review and get back to you. I gotta say this.... email is a very inefficient way to sort
and explain and resolve. A telephone call can do the same thing in 1/2 the time.
I am sorry you are not feeling top shelf. It is never fun to work when you don't feel well.

My questions about Horse Meadows are based on what was in the letter form the attorney. I am not sure if
you/owner are planning to propose anything new after receiving this news. Sounds to me like no gate is
needed and the access to Black Cat can be closed if the easement is moved to provide access across the new
public street.
Correct! What would be of assistance to you? Another redline of the DA?
That would be the preferred path for circulation, obviously. I was just wondering if anything about this DA Mod
proposal or the “concept plan” would be changing.
I can try to create a exhibit that shows the final disposition. It will be hand done- I am sorry... there just isn't
enough time as you well know.
I'll do my very best!
Third thing – Fairview Townhomes:
ACHD wants 7-foot attached sidewalk or 5-foot detached sidewalk along Wilson Lane. Based on space, I
presume the revision will be to widen the sidewalk to 7’ which is fine. However, the ALT approved the reduced
buffer of 6ish feet; reducing that further is not allowed without going through ALT again and I do not want to
support a 4’ wide planter strip in this area (loss of the 2 additional feet of sidewalk). I think the building should
be moved north to keep the same amount of landscaping as currently shown along Wilson with a 7’ sidewalk.
This can be handled with the CZC but I don’t want it to get brushed over up front.
Thank you, Penelope!
