Law No. 112-96, 126 Stat 156), mandates that state and local governments “may not deny, and shall approve, any eligible facilities request for a modification of an existing wireless tower or base station that does not substantially change the physical dimensions of such tower or base station.” Additionally, if “the reviewing State or local government determines that the application is incomplete” [they] “must provide written notice to the applicant within 30 days of receipt of the application, clearly and specifically delineating all missing documents or information.” Under federal law, an Eligible Facilities Request is deemed granted with written notification in sixty (60) days after an application is filed with a local jurisdiction, excluding tolling.
