21-2282 Vacating Public Utiity, Drainage, Irrigation Easement - Victory Commons H-2021-0045 RESOLUTION NO. 21-2282 CITY OF MERIDIAN BERNT, BORTON, CAVENER, BY THE CITY COUNCIL: HOAGLUN, PERREAULT, STRADER A RESOLUTION VACATING A PUBLIC UTILITY, DRAINAGE, AND IRRIGATION EASEMENT THAT WAS INITIALLY ESTABLISHED WITH THE MUSSELL CORNER SUBDIVISION (RECENTLY REPLATTED AS THE VICTORY COMMONS SUBDIVISION NO. 1) SITUATED IN GOVERNMENT LOT 4 OF SECTION 19, TOWNSHIP 3, RANGE 1 EAST, BOISE MERIDIAN, ADA COUNTY BEING LOCATED IN LOTS 1, 2 AND LOT 4, BLOCK 1 OF MUSSELL CORNER SUBDIVISION ON FILE IN BOOK 95 OF PLATS IN PAGES11624-11626, IN THE OFFICE OF THE RECORDER, ADA COUNTY, IDAHO; AND PROVIDING AN EFFECTIVE DATE. WHEREAS, on August 10, 2021 the City Council of Meridian, held a hearing on the vacation of a public utility, drainage, and irrigation easement that was initially established with the Mussell Corner Subdivision(recently replatted as the Victory Commons Subdivision no. 1)situated in Government lot 4 of section 19, township 3, range 1 east, Boise Meridian, Ada County being located in lots 1, 2 and lot 4, block 1 of Mussell Corner Subdivision on file in Book 95 of plats in pages11624-11626, in the office of the Recorder, Ada County, Idaho; and WHEREAS, after such hearing, the City Council, by formal motion, did approve said described vacation; and NOW THEREFORE, BE IT RESOLVED BY THE MAYOR AND CITY COUNCIL OF THE CITY OF MERIDIAN CITY,IDAHO: Section 1. That the public utility, drainage, and irrigation easement that was initially established with the Mussell Corner Subdivision (recently replatted as the Victory Commons Subdivision no. 1) situated in Government lot 4 of section 19, township 3, range 1 east, Boise Meridian, Ada County being located in lots 1, 2 and lot 4, block 1 of Mussell Corner Subdivision on file in Book 95 of plats in pages11624-11626, in the office of the Recorder,Ada County, Idaho, as attached in Exhibit A, is hereby vacated. Section 2. That this Resolution shall be in full force and effect immediately upon its adoption and approval. Passed by the City Council of the City of Meridian, Idaho, this 24th day of August, 2021.
