Mark,
It looks like I have everything I need except for two things:
A condition of approval of the conditional use permit was for a common open space exhibit to be
provided with the CZC that shows the requirements of UDC 11-4-3-27 are met. You mentioned this
was shown on site plan sheet A1.0. Where is this? I do not see it. I have provided an example of an
open space exhibit. What I need is an exhibit giving the total qualified open space quantifying which
meets the requirements of UDC 11-3Ga. The exhibit should show which areas meet the following:
a. Open grassy area of at least fifty (50) feet by one hundred (100) feet in area;
b. Community garden
c. Ponds or water features;
d. Plaza
e. Linear open space area that is at least twenty (20) feet and up to fifty (50) feet, has an access
at each end, and is improved and landscaped as set forth in subsection (E) of this section.
There is a very small amount of light spill at the NE corner of the property (see red-marked plan).
Isn’t this directly adjacent to a residential use? UDC 11-3A-11. – “Outdoor Lighting” limits all light
emitting from any parcel shall not cause the light level along any property line abutting a residential
use to exceed 0.1 foot-candle. Light readings shall be measured at a height of sixty (60) inches above
grade and in a plane at any angle of inclination. Any light exceeding 0.1 foot-candle, when
documented in the above manner, and extending onto an abutting residential use constitutes light
trespass.
