I might recommend tweaking the "residential" uses language just to make sure to clarify the buffer reduction applies to the nursing facility. If your initial neighborhood meeting notice did not mention the buffer reduction, you'll have to do another one. I'm not going to hold you up for this reason, but this must be done prior to Council or I'll have to recommend continuance. It can be as easy as setting a virtual meeting time, giving the notice as is required, and being available for questions from the community. I've looped Kim in to get the mailing list and maps for you if you need them. I am scheduling this for the September 14, 2021 Council meeting. The narrative says you are proposing to build a new 5,800 sq. ft. residential care facility. I really need a signed narrative describing the DA Mod. It can read like the following: Note 12 of the approved development agreement for Sundance Subdivision (Inst. #102056126) states that due to the single family uses abutting the boundaries of Lots 45, 47 and 49 Block 7, a minimum 20-foot planting strip, in accordance with City Ordinance 12-4-7.A is required along the property lines of these lots. On July 15, 2021, the Planning Commission approved CUP H-2021-0040 (Brightstar Care Meridian CUP) with a condition that the applicant shall either meet the 20' residential landscape buffer requirement, or request a development agreement modification through the City Council prior to submitting a certificate of zoning compliance application. You request Note No 12 of the Sundance Subdivision DA be revised to read: Due to the single family uses abutting the boundaries of Lots 45, 47 and 49 Block 7, a minimum 20-foot planting strip, in accordance with City Ordinance 12-4-7.A is required along the property lines of these lots, except the planting strip can be reduced to 10' for nursing and residential care facilities on Lot 47, Block 7. Also, did you specifically mention this buffer reduction in your notification letter for the neighborhood meeting? If this was not specifically listed as part of the proposal, you'll need to have another neighborhood meeting. This could be as simple as sending out notification letters describing the above, and setting a date and time for a virtual meeting. Since you already did one for the conditional use and had a public hearing that did describe the reduction, I am not going to hold up getting your application scheduled for hearing, but this neighborhood meeting must occur prior to the City Council meeting or I'll have to have it continued.
