Broadway Ave. Meridian, ID,83642 Re: Development Agreement Modification for Brightstar Residential Living 3336 N Meridian Rd.,Meridian,ID,83642 Dear Planning Staff, The owner of the property located at 3336 N.Meridian Rd is proposing the new construction of an approximately 5,800 s.f.single story residential care facility.The purpose of this request is to clarify the intent of the 20'landscape buffer along the North property line. Per Page 4,Item 4.1 of the original development agreement,Lot 47, Block 7 was assumed to have an"office use".See excerpt below; "4.1 The uses allowed pursuant to this Agreement are only those uses allowed under"City"'s Zoning Ordinance codified at Meridian City Code Section 11-7-2 D which are herein specified as follows: Construction and development of 214 single family lots and 23 common lots,4 office lots and a park. Development shall be consistent with the Meridian Comprehensive Plan Generalized Land Use Map which designates the property as Single Family Residential,that any proposed uses other than an office use on Lots 42,47,49 and 50,Block 7 shall require a conditional use,if constructed in accordance with an approved CUP site plan and plat." The owner discussed the landscape buffer with the HOA for the development and concluded that the original 20'landscape buffer was intended for adjoining commercial uses. The proposed 10'buffer would be acceptable for this proposed residential use.Please see the attached letter from the Developer. The applicant asks that the following clarification be made to the original Development Agreement, Instrument#102056126,approved on March 28,2002 and recorded on May 16,2002: • Page 6, Item 12—Change the condition to read: "Due to the single family uses abutting the boundaries of Lots 45,47 and 49 Block 7,a minimum 20-foot planting strip,in accordance with City Ordinance 12-4-7.A is required along the property lines of these lots for commercial uses.A minimum 10'planting strip is required for lots with nursing and residential care facilities,and other residential uses. Meridian Road — Memory Care Building To whom it may concern: The property owner at 3336 N. Meridian Road in Meridian is proposing a new residential care facility. In review of the Development Agreement there is a required 20' planting strip between the residential subdivision to the north and any commercial development. As a representative of the declarant (Settlers Crossing, LLC) and original developer of this business park, given the proposed residential care use of the building, we do not have a problem with the proposed reduced set back, provided the city approves and the building remains within the building setback per the zoning code. It is our opinion that the original intent of the 20' landscape strip provision within the Development Agreement was due to the proposed commercial office use, which can have more of an adverse impact on the existing residential homes.
