Re: ACHD Ustick Maintenance Facility(H--2020-0029)
Dear Mayor Simmons and Council:
In response to the City Council's ("Council") request for the ACHD Board of Commissioners'
("Board") commitment to the proposed City/Agency Comments & Conditions of Approval -
A.1(a j), I am writing to confirm the Board's agreement to the Council's proposed conditions,
with exception to Item A.1 0). The Planning and Zoning Commission proposed the condition:
"No building permit shall be submitted until phase 4 of the project consistent with the submitted
and revised phasing plan OR until the Ustick Road widening and deceleration lane at Naomi
Lane and Ustick is constructed."On July 12, 2021, ACHD previously responded and submitted a
substitute condition, which states: "Due to the fact there could be interim uses that may need a
building permit but do not require occupancy, the Applicant respectfully requests that the
condition be modified to read as follows: "No Certificate of Occupancy shall be issued until
phase 4 of the project consistent with the submitted and revised phasing plan, and a
deceleration lane along Ustick Road frontage is constructed."
During the Council's July 13, 2021 regular meeting, the Council raised concerns regarding the
impact of the maintenance facility on Ustick Road with additional truck traffic prior to
improvements. The Council requested that the Board commit to the accelerated improvement of
the Ustick Road widening road project. In response to the Council's request and in support of
this substitute condition, the Board is agreeable to the accelerate the widening project for Ustick
Road between Ten Mile and Black Cat to include design in 2022, right-of-way acquisition in
2023, and construction in 2024.
