DEVELOPMENT AGREEMENT MODIFICATION
Dear Mayor Simison and City Council:
On behalf of Black Cat 30 LLC, please accept the attached Development Agreement Modification
Application for Horse Meadows Subdivision at 710 N. Black Cat Road.
The Preliminary Plat for Horse Meadows Subdivision was approved by the Meridian City Council
on December 22, 2020 under application number H-2020-0060.
The reason for the request to modify the development agreement is that the Conditions Governing
Development of the Subject Property include a requirement that the Final Plat shall not be
submitted until the Applicant receives approval and provides documentation from all easement
holders of Parcels S1210325555, S 1210325 800 and S1210325710 to relinquish their rights to the
existing assess easement once the public road connection to Pine Avenue is constructed.
Two of the parcels----S121032555 and S1210325710, have agreed to relinquish their easement rights
and have signed the Easement Modification Agreement. The third parcel holder—S1210325800 has
declined to sign the Easement Modification Agreement. At the initial Neighborhood Meeting this
easement holder had no objections to the subdivision as proposed and asked only that the private
lane sign for Quarterhorse Lane be saved for them.
The Applicant has provided the agreement to the declining parcel holder and offered an incentive.
A final offer was to have been made in person recently but the representative was requested to leave
the property and was unable to make the additional incentive offer.
As indicated in the attached strikeout/replacement exhibit attached,the Applicant will preserve
Parcel S1210325800 access to Black Cat Road and wishes to move forward with platting Horse
Meadows Subdivision.
It appears at the time of the easement granting the original intent for Quarterhorse Lane was to be a
public street in the future given that the easement width matched the then current Ada County

Highway District ROW width of 50-feet. Since that time the standard ROW width has been
reduced to 47-Meet. As shown in the attached Google Earth image, only the gravel access surface
has been utilized by the easement holders, approximately 20 feet, and the remainder has been
fenced off and not utilized in any way.
