Please see responses to your questions below:
1. We have discussed the 20' northern landscape buffer. We have determined the Planning
Commission has the ability to reduce this buffer. I need a letter from you summarizing what
you are requesting and why the reduction should be granted. I suggest you consider
additional screening, better architecture on that side, etc. to justify why what you propose is
the same or better than what the buffer is trying to accomplish.
Jeff is working on this.
2. You'll have to address the encroachment on the City easement and how it will be resolved. Is
Public Works amenable to realigning the easement? (I'm forwarding this email to Bruce
Freckleton.) Will you slightly reduce the building on that side?
I have been in contact with Steve O'brien at the City of Meridian it looks like we will be able to
make adjustments to that easement. Please see his response below:
"Attached is a partial easement release form and the recorded water easement for Settlers
Crossing. The partial release easement can be used to pull back the existing easement from
the proposed building. A legal description and an accompany map depicting the portion of the
existing easement to be released will need to be prepared and submitted to the City. Attached
is a "how to"document for submitting documents online. Include the recorded easement
along with the submittal."
3. Please submit a copy of the cross access easement.

4. 1 need to know how parking works. It appears there are 5 parking spaces on the subject
property. Are these 5 dedicated solely to this property?Where is the 6th coming from? If the
additional parking is coming from another lot, do you have an agreement to use it? Does the
property that you're taking the parking space from meet their own parking requirements? If
this gets too complicated, can you add another parking space at the north end of the existing
lot (in front of the subject property)? It looks possible, but there appears some type of
mechanical equipment or pad in that area (looking at the aerial).
Please see attached excerpt from the Sundance Subdivision #5 CCRs in regard to the parking.
There are 5 spaces located on the west side of Parcel A. There are an additional 11 spaces on
the south side of Parcel B. The COA determines whether use or building size will cause the
parking lot to fall below the minimum required parking spaces. The COA and surrounding
neighbors are very happy with how under parked this facility will be. I believe there are 2 or 3
spaces needed during the week and residence visits are scheduled during the weekend.
I have also attached the CCRs they refer to maintenance of the parking lot as common and the
last page of the CCRs has an exhibit showing an access easement throughout the parking lot.
