Broadway Ave. Suite 102 Meridian, Idaho 83642 Re: Conditional Use Permit Application for Bright Star Residential Care Facility 3336 N. Meridian Rd.,Meridian,Idaho 83642 Dear Planning Staff, The owner of the property located at 3336&3340 N. Meridian Rd. is proposing the new construction of an approximately 5,800 s.f. residential care facility. The proposed use of the building will be a care facility for the elderly, featuring 12 bedrooms for residence and one office for staff. Dining, entertainment, laundry and storage shall be provided on-site for the residence. The facility will provide an aesthetic of residential style and feel for the residence and neighbors. The proposed project will help infill Settlers Crossing office complex. This type of facility would have very little impact to parking and traffic in the complex and the surrounding area. Please contact our office with any questions you may have in reviewing the application materials. Broadway Ave. Meridian, ID,83642 Re: Buffer Narrative for Brightstar Residential Living 3336 N Meridian Rd.,Meridian, ID,83642 Dear Planning Staff, The owner of the property located at 3336 N. Meridian Rd is proposing the new construction of an approximately 5,800 s.f. single story residential care facility. The purpose of this request is to reduce the 20' landscape buffer to 10'along the North property line. The owner discussed the buffer with the HOA for the development and concluded that the original 20' buffer was intended for commercial uses. The proposed 10' buffer would be acceptable for the proposed residential use. Please see the attached email from the HOA. The proposed landscape plan would include 11 deciduous trees in the Northern buffer giving us an approximate spacing of 12.5' between trees. As additional justification the proposed Northern landscape buffer would exceed city requirements by almost three times the required amount. This buffer would also include a maintained lawn. In addition there is an existing 6'wood fence abutting the property to the North. Considering the proposed residential use,the HOA acceptance of the proposed buffer, and the additional trees that exceed the City of Meridian Unified Development Code Title 11 article B(11-313-9) requirements the proposed project will be adequately screened per the code. Please contact our office with any questions you may have in reviewing the application materials. Planning Review Notes Alan Tiefenbach - Staff understands the proposed use would be a 12 bed memory care or assisted living facility. -This type of use would be classified as a nursing care or residential care facility. -This use would be allowed by conditional use in the L-O zone district. - Staff will need to see proof of access with this application. - Please note a 20' landscape buffer is required in the L-O zone district. -A site plan, landscape plan and building elevations will be required as part of the conditional use submittal. - Please note the property directly abuts existing single family residential. Staff implores the applicant to consider architecture appropriate with the existing residential neighborhood. -A CZC and Design Review will be required if the conditional use is approved, and prior to building permit. Good morning Alan, Please see responses to your questions below: 1. We have discussed the 20' northern landscape buffer. We have determined the Planning Commission has the ability to reduce this buffer. I need a letter from you summarizing what you are requesting and why the reduction should be granted. I suggest you consider additional screening, better architecture on that side, etc. to justify why what you propose is the same or better than what the buffer is trying to accomplish. Jeff is working on this. 2. You'll have to address the encroachment on the City easement and how it will be resolved. Is Public Works amenable to realigning the easement? (I'm forwarding this email to Bruce Freckleton.) Will you slightly reduce the building on that side? I have been in contact with Steve O'brien at the City of Meridian it looks like we will be able to make adjustments to that easement. Please see his response below: "Attached is a partial easement release form and the recorded water easement for Settlers Crossing. The partial release easement can be used to pull back the existing easement from the proposed building. A legal description and an accompany map depicting the portion of the existing easement to be released will need to be prepared and submitted to the City. Attached is a "how to"document for submitting documents online. Include the recorded easement along with the submittal." 3. Please submit a copy of the cross access easement. Please see attached agreement. 4. 1 need to know how parking works. It appears there are 5 parking spaces on the subject property. Are these 5 dedicated solely to this property?Where is the 6th coming from? If the additional parking is coming from another lot, do you have an agreement to use it? Does the property that you're taking the parking space from meet their own parking requirements? If this gets too complicated, can you add another parking space at the north end of the existing lot (in front of the subject property)? It looks possible, but there appears some type of mechanical equipment or pad in that area (looking at the aerial). Please see attached excerpt from the Sundance Subdivision #5 CCRs in regard to the parking. There are 5 spaces located on the west side of Parcel A. There are an additional 11 spaces on the south side of Parcel B. The COA determines whether use or building size will cause the parking lot to fall below the minimum required parking spaces. The COA and surrounding neighbors are very happy with how under parked this facility will be. I believe there are 2 or 3 spaces needed during the week and residence visits are scheduled during the weekend. I have also attached the CCRs they refer to maintenance of the parking lot as common and the last page of the CCRs has an exhibit showing an access easement throughout the parking lot. Let me know if you have any questions or need more information from us. Thank you for your help on this.
