Downtown District Second Amendment Agency ResolutionMERIDIAN DEVELOPMENT CORPORATION THE URBAN RENEWAL AGENCY OF THE CITY OF MERIDIAN RESOLUTION NO.21-023 BY THE BOARD OF COMMISSIONERS OF THE URBAN RENEWAL AGENCY OF MERIDIAN, IDAHO, AIKIA THE MERIDIAN DEVELOPMENT CORPORATION_ A RESOLUTION OF THE BOARD OF COMMISSIONERS OF THE URBAN RENEWAL AGENCY OF MERIDIAN, IDAHO, ALSO KNOWN AS THE MERIDIAN DEVELOPMENT CORPORATION, RECOMMENDING AND ADOPTING THE SECOND AMENDMENT TO THE MERIDIAN REVITALIZATION PLAN, WHICH SECOND AMENDMENT SEEKS TO DEANNEX CERTAIN AREAS FROM THE EXISTING MERIDIAN REVITALIZATION DISTRICT PROJECT AREA, ALSO KNOWN AS THE DOWNTOWN DISTRICT PROJECT AREA; AUTHORIZING AND DIRECTING THE CHAIR, VICE -CHAIR, OR AGENCY ADMINISTRATOR OF THE AGENCY TO TAKE APPROPRIATE ACTION; PROVIDING FOR THE RESOLUTION TO BE EFFECTIVE UPON ITS PASSAGE AND APPROVAL; AND PROVIDING AN EFFECTIVE DATE THIS RESOLUTION, made on the date hereinafter set forth by the Urban Renewal Agency of Meridian, Idaho, also known as the Meridian Development Corporation, an independent public body, corporate and politic, authorized under the authority of the Idaho Urban Renewal Law of 1965, Chapter 20, Title 50, Idaho Code, as amended (the "Law") and the Local Economic Development Act, Chapter 29, Title 50, Idaho Code, as amended (the "Act"), a duly created and functioning urban renewal agency for Meridian, Idaho, hereinafter referred to as the "MDC' WHEREAS, on July 24, 2001, the City Council (the "City Council') of the City of Meridian, Idaho (the "City"), adopted Resolution No. 01-367 establishing MDC pursuant to the Law; WHEREAS, on October 8, 2002, the City Council, after notice duly published, conducted a public hearing on the Meridian Revitalization Plan Urban Renewal Project, which is also referred to as the Downtown District (the "Downtown District Plan"), making certain findings and establishing the Downtown District revenue allocation area (the "Downtown District Project Area"); RESOLUTION NO. 21-023 - 1 WHEREAS, following said public hearing, the City Council adopted its Ordinance No. 02-987 on December 3, 2002, approving the Downtown District Plan and making certain findings; WHEREAS, the City Council, after notice duly published, conducted a public hearing on the Ten Mile Road Urban Renewal Plan (the "Ten Mile Plan"). The public hearing was continued to June 21, 2016, for further testimony; WHEREAS, following said public hearings, the City Council adopted its Ordinance No. 16-1695 on June 21, 2016, approving the Ten Mile Plan, making certain findings and establishing the Ten Mile revenue allocation area (the "Ten Mile Project Area); WHEREAS, the City Council, after notice duly published, conducted a public hearing on the First Amendment to the Meridian Revitalization Plan Urban Renewal Project (the "First Amendment to the Downtown District Plan"); WHEREAS, following said public hearing, the City Council adopted its Ordinance No. 20-1881 on June 9, 2020, approving the First Amendment to the Downtown District Plan deannexing certain parcels and making certain findings (collectively, the Downtown District Plan, and amendments thereto, are referred to as the "Existing Downtown District Plan," and the Downtown District Project Area, and amendments thereto, are referred to as the "Existing Downtown District Project Area"); WHEREAS, the City Council, after notice duly published, conducted a public hearing on the Union District Urban Renewal Project (the "Union District Plan"); WHEREAS, following said public hearing, the City Council adopted its Ordinance No. 20-1882 on June 9, 2020, approving the Union District Plan, making certain findings and establishing the Union District revenue allocation area (the "Union District Project Area"); WHEREAS, the Existing Downtown District Plan, the Ten Mile Plan, and the Union District Plan and their project areas are collectively referred to as the "Existing Project Areas;" WHEREAS, MDC seeks to further amend the Existing Downtown District Plan and the Existing Downtown District Project Area to deannex two (2) areas as described in the Second Amendment defined below, and as set forth in Exhibit 1 attached hereto. The first area is generally bounded by Meridian Road on the west and E. Fairview Avenue on the north. The eastern boundary extends south along what would be E. 4th Street if extended, over to 3rd Street. The southern boundary extends to E. Pine Avenue between E. 3rd Street and E. 2nd Street, and then travels up E. 2nd Street and over E. Washington Avenue to connect back to Meridian Road. This area is generally referred to as the "Northern Gateway Area." The purpose of the de -annexation of the Northern Gateway Area would be to allow the inclusion of these properties into a RESOLUTION NO, 21-023 - 2 proposed Northern Gateway Urban Renewal District. The second area is generally bounded by E. Idaho Avenue on the north, E. 2nd Street on the east, a portion of Broadway Avenue on the south, and E. Main Street on the west. This area is generally refer -red to as the 'Idaho Block." The purpose of the de -annexation of the Idaho Block would be to allow the inclusion of this block into a proposed amendment to the existing Union District Project Area; WHEREAS, MDC has reviewed the financial impact of the deannexation of the Northern Gateway Area and the Idaho Block from the Existing Downtown District Project Area on its allocation of revenue and has concluded the remaining allocation of revenue is sufficient to pay its operations and obligations, and to continue to implement the terms of the Existing Downtown District Plan; WHEREAS, MDC has prepared the Second Amendment to the Meridian Revitalization Plan (the "Second Amendment"), as set forth in Exhibit 1 attached hereto, identifying the area to be deannexed from the Existing Downtown District Project Area; WHEREAS, the Second Amendment amends the Existing Downtown District Plan, which contains provisions of revenue allocation financing as allowed by the Act; WHEREAS, the Second Amendment is expected to be adopted by the City Council in accordance with the requirements of the Law and the Act, specifically, but not limited to the requirements set forth in Idaho Code §§ 50-2008 and 50-2906; WHEREAS, the MDC Board finds it in the best interests of MDC and the public to recommend approval of the adoption of the Second Amendment, as prepared by MDC, and as set forth in Exhibit 1 attached hereto, and to forward it to the Mayor and City, for adoption in accordance with the requirements of the Law and the Act. NOW, THEREFORE, BE IT RESOLVED BY THE MEMBERS OF THE BOARD OF COMMISSIONERS OF THE URBAN RENEWAL AGENCY OF MERIDIAN. IDAHO, AS FOLLOWS: Section 1. That the above statements are true and correct. Section 2. That the MDC Board recommends that the Second Amendment, attached hereto as Exhibit 1, identifying the parcels to be deannexed from the Existing Downtown District Project Area, be adopted by the City Council including any sections, modifications, or text discussed at the May 12, 2021, MDC Board meeting. Section 3. That this Resolution constitutes the necessary action of MDC under the Law, Section 50-2008, Idaho Code and the Act. Section 4. The Chair or Vice -Chair of the Board of Commissioners, or the MDC Administrator are hereby authorized and directed to take all steps necessary and RESOLUTION NO. 21-023 - 3 convenient in partnership with the City to facilitate the City's adoption of the Second Amendment. Section 5. That this Resolution shall be in full force and effect immediately upon its adoption and approval, PASSED AND ADOPTED by the Urban Renewal Agency of the City of Meridian, Idaho, also known as the Meridian Development Corporation, on May 12, 2021.
