N OTES
1. EACH LOT IS HEREBY DESIGNATED AS HAVING A PERMANENT EASEMENT FOR
PUBLIC UTILITIES, DRAINAGE, SEWER AND STREET LIGHTS OVER THE TEN (10) FEET
ADJACENT TO ANY PUBLIC STREET. THIS EASEMENT SHALL NOT PRECLUDE THE
CONSTRUCTION OF HARD -SURFACED DRIVEWAYS AND WALKWAYS TO EACH LOT.
2. BUILDING SETBACK DIMENSIONS IN THIS SUBDIVISION SHALL CONFORM TO THE
APPLICABLE ZONING REGULATIONS OF THE CITY OF MERIDIAN, ADA COUNTY, IDAHO, 'IN
EFFECT AT THE TIME OF ISSUANCE OF A BUILDING PERMIT.
3. ANY RESUBDIVISION OF THIS PLAT SHALL COMPLY WITH THE APPLICABLE ZONING
REGULATIONS IN EFFECT AT THE TIME OF THE RESUBDIVISION OR AS ALLOWED BY
CONDITIONAL USE PERMIT.
4. THE LOT OWNER IS RESPONSIBLE FOR THE MAINTENANCE OF ANY IRRIGATION OR
DRAINAGE PIPE CROSSING SAID LOT UNLESS SAID RESPONSIBILITY IS ASSUMED BY AN
IRRIGATION OR DRAINAGE AUTHORITY.
5. THE BOTTOM OF BUILDING FOOTINGS SHALL BE SET A MINIMUM OF 12 INCHES
ABOVE THE HIGHEST ESTABLISHED NORMAL GROUND WATER ELEVATION.
6. A CLEAR VISION SIGHT TRIANGLE WILL BE PROVIDED AT ALL STREET
INTERSECTIONS PER MERIDIAN CITY ORDINANCE. WITHIN THIS TRIANGLE, NO
OBSTRUCTION HIGHER THAN 36 INCHES ABOVE THE TOP OF PAVEMENT WILL BE
ALLOWED, INCLUDING LANDSCAPING, BERMS, FENCES, WALLS OR SHRUBS.
7. AS SHOWN HEREON, THERE IS A CITY OF MERIDIAN SANITARY SEWER EASEMENT
ALONG THE LINE COMMON TO LOTS 10 AND 11, BLOCK 1. THE OWNERS OF THESE
LOTS ARE REQUIRED TO PROVIDE ACCESS TO THE CITY OF MERIDIAN AT ALL TIMES.
WHILE PERFORMING MAINTENANCE OR CONSTRUCTION DUTIES ON THEIR FACILITIES
WITHIN THIS EASEMENTS, THE CITY OF MERIDIAN SHALL ONLY RESTORE THE ORIGINAL
14' GRAVEL ACCESS ROAD. ANY REPAIR OF OTHER SITE IMPROVEMENTS SUCH AS
PAVING, LANDSCAPING, ECT., SHALL BE THE RESPONSIBILITY OF THE LOT OWNERS.
ALL BUILDINGS AND STRUCTURES SHALL BE PROHIBITED WITHIN THE LIMITS OF THIS
EASEMENT. THIS EASEMENT SHALL REMAIN FREE OF ALL ENCROACHMENTS AND
OBSTRUCTIONS (INCLUDING FENCES AND TREES) WHICH MAY ADVERSELY AFFECT THE
OPERATION AND MAINTENANCE OF UNDERGROUND PIPES.
8. A PORTION OF LOT 10 OF BLOCK 1 IS SERVIENT TO AND CONTAINS THE ACHD
STORM WATER DRAINAGE SYSTEM. THIS LOT IS ENCUMBERED BY THAT CERTAIN
MASTER PERPETUAL STORM WATER DRAINAGE EASEMENT RECORDED ON JUNE 1, 2004
AS INSTRUMENT NO.104068411, OFFICIAL RECORDS OF ADA COUNTY, AND
INCORPORATED HEREIN BY THIS REFERENCE AS IF SET FORTH IN FULL (THE "MASTER
EASEMENT"). THE MASTER EASEMENT AND THE STORM WATER DRAINAGE SYSTEM ARE
DEDICATED TO ACHD PURSUANT TO SECTION 40-2302 IDAHO CODE. THE MASTER
EASEMENT IS FOR THE OPERATION AND MAINTENANCE OF THE STORM WATER
DRAINAGE SYSTEM.
9. THE 20 FOOT LANDSCAPE SETBACK ON LOTS 1 THROUGH 5, BLOCK 3, SHALL BE
RESERVED FOR LANDSCAPING REQUIRED BY THE CITY OF MERIDIAN. THESE LOTS
SHALL PROVIDE LANDSCAPING AS REQUIRED BY THE CITY OF MERIDIAN.
10. ALL LOTS WITHIN THIS SUBDIVISION ARE SUBJECT TO THE TERMS OF A
DEVELOPMENT AGREEMENT RECORDED IN THE OFFICE OF THE ADA COUNTY RECORDER,
INSTRUMENT NO. 104056166.
11. RESTRICTIVE COVENANTS WILL BE IN EFFECT FOR THIS SUBDIVISION.
