Additional Meeting Notes: Comply with the provisions in the existing Development Agreement as amended;or apply for a modification. • A Conditional Use Permit is required for an outdoor stage or music venue recreation facility in the C-G zoning district(temporary or permanent); compliance with the specific use standards in UDC 11-4-3-2 for indoor/outdoor entertainment or recreation facilities is required as follows: A. General standards. 1. All outdoor recreation areas and structures that are not fully enclosed shall maintain a minimum setback of 100' from any abutting residential districts.The playing areas of golf courses, including golf tees,fairways,and greens,are an exception to this standard. R1 zoning abuts this property on the east but the homes have been removed in preparation for future rezone to a commercial district&redevelopment. The Site Plan should accommodate this setback or the adiacent property should be rezoned to a non-residential zone. 2. No outdoor event or activity center shall be located within fifty(50)feet of any property line and shall operate only between the hours of 6:00 a.m.and 11:00 p.m.A CUP may be requested for extended hours. The Site Plan should depict a minimum 50'setback from the east property line. 3. Accessory uses including, but not limited to, retail, equipment rental, restaurant and drinking establishments, may be allowed if designed to serve patrons of the use only. 4. Outdoor speaker systems shall comply with section 11-3A-13, "outdoor speaker systems", of this title. (requires any outdoor speaker system to be located a min. of 100'from all residential districts—maV be waived through approval of a CUP.)Apply for CUP if necessary. B. Additional standards for swimming pools.Any outdoor swimming pool shall be completely enclosed within a six-foot non- scalable fence that meets the requirements of the building code in accord with title 10, chapter 1, of this Code. C. Additional standards for outdoor stage or musical venue.Any use with a capacity of one hundred (100)seats or more or within one thousand (1,000)feet of a residence or a residential district shall be subject to approval of a conditional use permit. • Compliance with the dimensional standards of the C-G district listed in UDC Table 11-213-3 is required. • Hours of operation in the C-G district are limited from 6:00 am to 11:00 pm when the property abuts a residential use or district. Extended hours may be requested with the CUP per UDC 11-2B-3B. • Provide a minimum 5'wide pedestrian walkway within the street buffer along 1-84&along main drive aisles as required in the DA (#5.5) • Comply with City noise ordinance(MCC 6-3-6)—noise may not create a public disturbance as defined, between the hours of 11:00 Pm and 6:00 am or at any time so as to unreasonably disturb or interfere with the peace, comfort or enjoyment of others. Note:A Traffic Impact Study(TIS) will be required by ACHD for large commercial projects and any residential development with over 100 units. To avoid unnecessary delays&expedite the hearing process, applicants are encouraged to submit the TIS to ACHD prior to submitting their application to the City. Not having ACHD comments and/or conditions on large projects may delay hearing(s)at the City.
