As was always contemplated with the entitlements obtained in 2016, WinCo intends to sell the eastern parcel to a compatible user. WinCo fully supports the proposed apartments, which complement the planned commercial uses already approved on our western parcels. We have only one concern. WinCo Foods objects to City staff's proposed Condition 3c, which requires: "The extension of E. Cinema Dr. shall be included in the first phase of development." The Cinema Drive extension is not needed to serve the apartments—the only use in phase 1. This has been established by the applicant's traffic engineer and TIS, which assumed zero trips on Cinema Drive. Based on this information, ACHD approved the phasing plan with the Cinema Drive extension in phase 2. The Cinema Drive extension is already required to be developed in phase 2, with development of the western commercial parcels. WinCo has no objection to that requirement. Advancing the Cinema Drive extension to phase 1 is not only unnecessary to serve phase 1, it is problematic. WinCo does not yet have specific users for the commercial parcel fronting Overland, south of Cinema Drive. Until those plans are finalized with development of phase 2, the exact placement of Cinema Drive is unknown. It is impractical and wasteful to build this road now only to have to rip it out and reconstruct it with the commercial phase. The road would bisect and prematurely end the current farming operations by our tenant farmer. Subsequent demolition and reconstruction of the road would interrupt and displace the new traffic patterns and temporary connectivity City staff asserts is the basis for the proposed condition. The additional construction activities would create a nuisance for surrounding homes and businesses.
