EASEMENT
Sanitary restrictions as required by Idaho Code, Title 50, Chapter 13, have been satisfied
based on the State of Idaho, Department of Environmental Quality (DEQ) approval of the
design plans and specifications and the conditions imposed on the developer for continued
satisfaction of the sanitary restrictions. Buyer is cautioned that at the time of this
approval, no drinking water or sewer/septic facilities were constructed. Building
construction can be allowed with appropriate building permits if drinking water or sewer
facilities have since been constructed or if the developer is simultaneously constructing
those facilities. If the developer fails to construct facilities or meet the other conditions
of DEQ, then sanitary restrictions may be reimposed, in accordance with Section 50-1326,
Idaho Code, by the issuance of a certificate of disapproval, and no construction of any
building or shelter requiring drinking water or sewer/septic facilities shall be allowed.

NOTES
1. Building setbacks and dimensional standards in this subdivision shall be in compliance
with the applicable zoning regulations of the City of Meridian, Idaho.
2. Any re -subdivision of this plat shall comply with the applicable zoning regulations in
effect at the time of the re -subdivision.
3. All lot lines common to public right-of-way and the exterior boundary of Cedar Springs
Subdivision No. 5 have a 10' wide permanent public utilities, drainage and Settlers Irrigation
District easement, unless otherwise dimensioned. However, this shall not preclude the
construction of proper hard surfaced driveways for access to each individual lot.
4. A 10-foot wide permanent public utilities easement is designated to be centered on
interior side lot lines, unless otherwise dimensioned.
5. The Owner shall comply with Idaho Code, Section 31-3805 or its provisions that may
apply to irrigation rights.
6. The owner of each lot, across which passes an irrigation/drainage ditch or pipe, is
responsible for the maintenance thereof unless such responsibility has been assumed by an
irrigation/drainage district.
7. Lots 2, 12, 13, 14 and 16 of Block 37 shown hereon are common lots and will be
owned and maintained by the Cedar Springs North Business Association, Inc..
8. Restricted Access -No lots in this subdivision shall be provided with an access to W.
McMillan Road or North Summit Way, except as shown hereon, unless said access is
specifically approved by the Ada County Highway District, and the City of Meridian.
9. Refer to Record of Survey No. 5117 for further survey information.
10. All lots within the boundary of this plat are subject to the terms and conditions of a
construction contract for urban irrigation system recorded as Instrument No.104017498.
11. This subdivision recognizes Section 22-4503 of the Idaho code, Right -to -Farm Act
which states: "No agricultural operation or an appurtenance to it shall be or become a
nuisance, private or public, by any changed conditions in or about the surrounding
nonagricultural activities after the some has been in operation for more than one (1) year,
when the operations was not a nuisance at the time the operation began; provided that
the provisions of this section shall not apply whenever a nuisance results from the
improper or negiigent operation of any agricultural operation or appurtenance to it.'
12. A blanket perpetual ingress/egress easement is hereby reserved over all of Lot 14,
Block 37. Said easement does hereby create a reciprical parking lot access for each
buildable lot, said easement shall run with the land.
13. A blanket sanitary sewer and water line easement is hereby reserved over all of Lot 14,
Block 37 for the benefit of the City of Meridian. Also a blanket public utility easement is
hereby reserved over all of lot 14, block 37.
14. An irrigation and drainage easement is hereby reserved as shown hereon, for the
benefit of Settler's Irrigation District, in accordance with Instrument No.104017498 who will
maintain said easement.
15. An irrigation easement, dimensioned as shown hereon, is hereby reserved for
downstream irrigation users.
16. The bottom elevation of stuctural footings shall be set a minimum of 12 inches above
the highest established normal groundwater elevation.
