The Findings of Fact, Conclusions of Law, and Decision and Order entered in this matter are a final decision on a land use application; however the Development Agreement must be executed within six (6) months of the approval date noted above per UDC 11-5B-3F. The property owner has the right to request a regulatory taking analysis under Idaho Code §67- 6513. Such request must be in writing, and must be filed with the City Clerk not more than twenty-eight(28) days after the final decision concerning the matter at issue.
