Dear Mr. Erickson:
This letter is to confirm that the City Council approved the subject application at their February
23, 2021 meeting. The Findings of Fact, Conclusions of Law, and Decision and Order entered
in this matter are a final decision on a land use application; however the Development
Agreement must be executed within six (6) months of the approval date noted above per UDC
11-5B-3F.
The property owner has the right to request a regulatory taking analysis under Idaho Code §67-
6513. Such request must be in writing, and must be filed with the City Clerk not more than
twenty-eight(28) days after the final decision concerning the matter at issue. A request for a
regulatory takings analysis will toll the time period within which a Petition for Judicial Review
may be filed.
