Comments & Concerns from Kevin & Norma Petty 1155 W Victory Rd (property bordering on 2 sides by proposed subdivision) We are not opposed to the annexation and zoning development of this property. However, we are concerned that the current plat is not congruent to the future use or development of our adjacent piece of property. This subdivision should not be allowed to impact us because of a faulty design that relies on use of our property. Our conversations with ACHD have left us with some concerns: • 64 additional lots increases traffic on South Kentucky Way. Adding this traffic to the current demand from Kentucky Ridge Subdivision would result in approximately 120- 130 homes relying on that road as their current (and only) access point. ACHD mentioned that the maximum capacity is 100 homes. Without access through my property, the development would exceed capacity for South Kentucky Way. • Apparently the current density is 4 homes per acre. We own a full 5 acres. Should we ever want to develop our property, ingress and egress into neighboring subdivisions should also factor into any calculations regarding additional road access that is necessary. • The Preliminary Plat calls for future road access through our property. It appears that the developer cannot complete the subdivision without using our property as an additional access point. The access in question does not belong to him. It belongs to us. The access point was chosen by the city, ACHD or the developer, not us. • The developer has no right to assume his needs have a superior right to the access point because he is first in time. Their design should stand alone, and the burden of not exceeding the housing quota for that access falls on him. • We don't want to be forced into development, nor be in a jeopardizing position where our property could ever be confiscated by Eminent Domain so they can finish out their subdivision. All neighboring property should be protected. • There is no incentive for us to obligate our property with this design. • We request written drawings and specifications on the uninterrupted irrigation water delivery from the Sundell Lateral weir and plans for water waste removal along West Victory Road to ensure the continued agricultural use of our property. • We request a 6 foot solid privacy fence between the subdivision and our property. Further, this fence should be installed at the beginning of the development to mitigate the noise, dust and debris that results from construction of new roads and homes. In summary, we request P&Z make sure any development meets all the various regulations concerning developments, make sure it is consistent with future developments and doesn't negatively impact neighboring property, their current use and future potential development. Unfortunately I cannot attend, but would like to comment on one of the agenda items.When I used the city's website to find contact information, one link sent me to information on how to apply; another contact link listed the city clerk staff. Hopefully you are the right person to contact, or you could point me in the right direction. I am writing concerning the agenda for the March 6, 2014 Planning and Zoning Commission meeting. Specifically, agenda item 4G, the proposed housing on the NW corner of the Locust Grove and Ustick intersection. I am a resident living near the proposed development and I am concerned about the impact that additional construction has on our schools. I propose that the Planning and Zoning Commission not approve construction until the school attendance boundaries are changed. Furthermore, I recommend that the Commission work with the school board to ensure that new developments are designated to attend schools that are under -enrolled, or at least less over crowded than the neighborhood school. As it stands, the proposed development would add an additional 121 homes to Prospect Elementary, a school that is the most over crowded elementary school in the district. It already has 800 kids in a school built for 650, plus many new construction projects already approved. Discovery Elementary is actually closer to this development. With 534 students and a capacity for 650, it is under enrolled. It is exceptionally hard for the school board to change attendance zones once homes are already purchased and occupied. I strongly suggest that you take this opportunity to work with the school board now, before people make decisions on where to buy their home. Our overcrowded schools are making Meridian less of "a great place to raise a family". And while attendance boundaries aren't the Planning and Zoning Commission's area of responsibility, I believe you do have a responsibility to plan future development with the school board.
