Since the agenda for next Tuesday has already been published, we need something in writing from you/your team
requesting that the item not be heard next Tuesday. An email will suffice but we do need something from the Applicant
making this request. I am not sure if the item will be continued to a new date or if it will simply be vacated from the
agenda as if it weren’t there.
I’ll handle that part but I just need the email making the request by you.

Now that I am thinking about this more, the condition cannot be changed because the language is actually in the
Development Agreement that was signed and recorded. This final plat condition has much less weight than the DA and I
was only trying to continue that condition forward as a courtesy thinking that it may be forgotten as this progresses and
changes hands.
To change a DA provision requires a public hearing in front of Council for a Development Agreement Modification. That
opens up the entire DA for review which could result in more provisions and would delay any platting.

Sorry about the confusion. We will send a corrected plat for the Lot 9, Block 2 change. Would you be will to say “or
approved design by Geotechnical engineer”. Right now our concern is ACHD is asking for a wetland pond with the
current information. We will be digging a deep test hole soon to hopefully give them what they need to keep the to the
Geotech report but in the small chance that fails we may have to look at options that are different than originally
planned and don’t want to run into problems with the City or Meridian later on if that happens. I didn’t realize the
sidewalk deferral was in the summary analysis. Sorry about that. Let me know on the other things and I can update the
letter.

I am a little confused by the letter. Lot 9, Block 2 is specifically stated as a common lot on the submitted final plat.
Second to that, it is shown as a platted lot regardless. If it is intended to be an easement, it should not be platted and
shown as a lot. If it is an easement, it would negate the comments regarding street frontage for Lot 3, Block 2 containing
the existing home.
Regarding the drainage condition, Staff is not comfortable changing that language because the language was pulled
straight out of the Geotech report and had nothing to do with ACHD; Staff does not want to blend the two topics.
I believe I did note within the report that the sidewalk along Victory will be deferred via a road trust and constructed as
part of the Locust Grove/Victory roundabout improvements.
