WHEREAS, the City Council and the Mayor of the City of Meridian, Idaho, have concluded that it is in the best interest of said City to amend and change the zoning from R-4 Residential to LO Limited Office, for the following described parcel: Lot 1, Block 1, Whitetail Subdivision, Meridian, Ada County, Idaho. NOW, THEREFORE, BE IT ORDAINED by the Mayor and City Council of the City of Meridian, Ada County, Idaho: Section 1. That the aforementioned real property which is described as follows: Lot 1, Block 1, Whitetail Subdivision, Meridian, Ada County, Idaho. be, and the same is rezoned from R-4 Residential to LO Limited Office, and Section 11-2-425, Official Zoning Maps is hereby amended to reflect the same. Section 2. That the property shall be subject to being rezoned back to R-4 Residential if the property does not meet the Sewer and Water Ordinance; the fire, life safety, and uniform building codes, all of the Ordinances of the City of Meridian, or if all parking and driveway areas are not paved; specifically the property shall meet the fence ordinances of the City of Meridian. Section 3. Linda Paddock is requesting a rezone of an 8,778 square foot lot locat- ed at the northwest corner of Cherry Lane and NW 11th Street from R-4 to LO (Limited Office) which would allow a conditional use permit for a day care center at the existing residence. 2. Cherry Lane is designated a minor arterial street on the 2010 Urban Functional Street Classification Map requiring a minimum 80-feet of right-of-way. Cherry Lane has 80-feet of right-of-way and is fully improved with a 65-foot street section. 3. 11 th Street is a local street that has 50-feet of right-of-way (which is adequate), and is fully improved. The pavement is new, so no utility cuts will be allowed in the pavement. 4. The site plan shows the existing curb cuts along Cherry Lane will be utilized for a one-way (westbound) traffic pattern for the day care center. It also shows six angled parking spaces for compact cars next to the existing sidewalk. There is only 23-feet of space from the side- walk to the house which, after allowing a 12-foot wide through lane, leaves just ll-feet for parking area. With angled parking spaces, this layout will not fit. There will be six parking spaces off the 11th Street frontage. 5. There may be eligibility for offsets against impact fees or compensation for dedication of right-of-way or construction of system improvements in accordance with ACHD Ordinance #184. A person seeking offsets must submit an application to the impact fee administrator prior to breaking ground in accordance with Section 12 of the above-referenced ordinance. 6. We request that the applications be deferred until these problems can be satisfactorily resolved. 1. 2. The Landings. ACHD staff has requested the applicant to redesign and resubmit the preliminary plat altered to do the following: a. Terminate Waltman Lane at the east boundary of the subdivision. Pedestrian and emergency access may be provided between Waltman Lane and the subdivision interior. b. Stub out a new collector street to the north or east near the north- east corner of the subdivision. Much of the property northeaster- ly of this location is still undeveloped and the collector will be extended out to Franklin or Meridian Roads as the property devel- ops. c. Provide a collector street out to the west project boundary near the mid -section line. No direct lot access to this street will be allowed. Day Care Center at Cherry Lane and NW 11th. This proposal presents some serious circulation and safety problems. a. Because of the shape of the property, the applicant is proposing a circle drive in/out on Cherry Lane which ordinarily would be good to avoid vehicles having to back out onto Cherry Lane. However, in this case, the eastern access point is only a few feet from the NW 11th Street intersection, causing a serious conflict between vehicles turning into the day care and vehicles entering Cherry Lane from NW 11 th Street. ado county highway district 318 East 37th. An existing irrigation box has been constructed in the vision trian- gle at the NW corner of Cherry Lane and NW 11 th Street which already seriously impairs the clear vision of drivers entering Cher- ry Lane from NW 11 th Street. c. The applicant is proposing six off street parking spaces in the area between the circle driveway and Cherry Lane. This will further confuse and impair the circulation and vision situations. Since this application is for a rezone, ACHD certification is not re- quired and we can only recommend action to the City. This application has not yet been heard by the ACHD Commission, but in order to meet your hearing and staff report schedule, we are transmitting these staff opinions for your consideration. The ACHD Commission will hear the items on July 9, 1992 at which time we will transmit the District's offi- cial action to you. We recommend the following on the day care center: 1. The site plan be revised to eliminate the entrance to Cherry Lane near the east end of the property and the existing curb cut be replaced with vertical curb. 2. A turnaround be provided at the east end of the property in lieu of the access to Cherry Lane so that all traffic will enterlleave Cherry Lane at the western location. 3. Another option would be to loop the driveway around and behind the dwelling to access NW 11th Street, but this would involve much more construction and would use up most of the proposed play area. Guy Walker, 9119 Austin, Boise, was sworn by the attorney. 8 8 PLANNING & ZONING COMMISSION JULY 14, 1992 PAGE 8 Boesiger: When we were initially approached on this proposal we weren't excited because after all we did buy the ground for the Vineyards Subdivision. As we got to thinking about it, we began to realize that as the Vineyard's Subdivision developed toward Linder Road, we would have houses that would be backing up to the Maverick Store and to that busy intersection and we began to realize that having this Church on a large parcel of ground would provide a good buffer between that busy intersection and the commercial and a residential. We got together with the Church people and we think it's good planning to provide for a transitional use between commercial ~nd residential and we think it's going to be in the best interest of the future homeowners in the Vineyards Subdivision to have that buffer. We would not be in favor of any use other than this specific proposal. We would like to ask that if for some reason the Church doesn't get built that the zoning would revert back to R-4. Rountree: If his latter comment is a concern, the transaction for this purchase? is that a part of Boesiger: No. Johnson: Thank you. Anyone else to testify? Doug Hoy, 1806 SE 5th Way, was sworn by the attorney. Hoy: I go to the Meridian Church of Christ. Our plans are that if the zoning commission approves and the Council approves and changes zoning we will be building a church building there.' We have already got an architect hired and getting everything ready. We are not a real large church. We are looking at about 25 or 30 cars is all. Ten years from now we are looking at a maybe 50 to ó0 automobiles maximum at one time that would be utilizing Linder Road. Johnson: Thank you. Anyone else to testify? will close the public hearing. Discussion - see tape. 8 . PLANNING & ZONING COMMISSION JULY 14, 1992 PAGE 10 Walker: As you are aware, Linda Paddock now is operating the Inchworm Day Care facility here in Meridian. There is a backup demand waiting to get into her facilities. Therefore we are proposing another Day Care for her on the corner of 11th and Cherry Lane. In reviewing the ACHD and the City Engineer's comments I have prepared some alternatives to some of their recommendations. Passed out copy of plat to Commission. W~ feel that our original proposal outside of the parking along the front is still a more viable type of solution to the turn-a~ound to go through the Day Care. Our reasoning for that is that 11th Street only has a stop sign on it. That stop sign would help with slowing down the traffic and controlling the traffic so that when people enter into the easterly part off of Cherry Lane, they are already going to be stopped or observing traffic off of Cherry Lane at that time. They would turn in and either park along the front then exiting on the westerly part. Explained parking - see tape. Feel that the nine parking spots plus the drive through is going to be more than adequate for the amount of children that are going to be there. She is proposing that her marketing is going to be for primarily infants up to three years old. There was' some concern regarding the irrigation box that is sitting in the corner, that side is part of the public right-of-way that was approved with the Whitetail Subdivision and has already been approved by ACHD as far as the City and along with Deerfield. I did speak with the irrigation department regarding that and they are very dubious whether they would allow any kind of alteration to that alteration box whatsoever. It does not create a vision problem when you go up there. That has been determined by your Engineer and ACHD. Johnson: How' high is it? Walker: itself. Four feet. It has already been approved on the plat Johnson: On your handout, are you proposing any type direction arrows painted anywhere or is it just either way? of Walker: Absolutely. There would be stripping of all the parking spots and as well as a marking of the entrance. Hepper: How many children would be in this facility? Walker: Maximum 35. . 8 PLANNING & ZONING COMMISSION JULY 14, lc:1c:12 PAGE 11 \ Rountree: When you indicated that you had looked at ACHD's comments, we received two comment letters from them on this particular request. The way I read their specific comments is they are saying that the easterly curb cut on Cherry Lane be closed and the existing curb cut, the rest of that be the access to the driveway and that the driveway go in front of the facility and develop a loop in the vicinity of where the easterly curb cut is now. I assume by that they want access egress and so forth at the curb cut on Cherry Lane away from the intersection at 11th. I also read into this that they do not want access on 11th Street that close to the intersection with Cherry Lane and I can understand why. The other option they presented is coming off the furthest west access on Cherry Lane behind the facility and then accessing 11th Street further down. I agree with their specific comments about access. Walker: I appreciate your comments. I might make the comment that as you are aware on Cherry Lane there is a turning lane in the middle of Cherry Lane and if in fact vehicles are coming from 11th Street, stopped at that stop sign and are making a left or right turn, they are not going to be of any consequences to anybody entering the Day Care as is proposed. (Further Discussion - see tape) Walker: At this time "we would request approval for the this zoning with the exception of a design that would meet the approval of the Commission and the City Engineer as far as parking and the loop which we could redesign and make the loop go around back. Johnson: Thank you. Anyone else? Jane Davlin, ó03 Lawndale Drive, was sworn by the attorney. Davlin: Inchworm Day Care as it is right now is about 15 feet from our property. When they got their permit last time, they started work 'on a Saturday morning at 6:30 in the morning. I called Linda Paddock at home and asked her if she'd please stop it and she did. If they get this other one I would hope they would be a little more considerate of the neighbors. I am able to hear and see what goes on at the present location. On two occasions there was a child on the roof. They also allow chilp:en to go into the fenced area behind where the apartments are and get the toys that have been thrown over the fence. Last 8 . Nobody asked me who I was, why I was taking this child or anything else. In their flyer they assure parents that they do check I.D.. When I heard they were going to open a new facility I decided to take a tour of the whole facility. Davlin: I only work maybe one day a,month that I have to leave but I also when I get my child up for school if I don't have something to put in her lunch I run up to Circle K, that's around anywhere from 7:30 to 8:30 A.M.. But I did visit to see about enrolling my children at this facility. When I visited, I was also told that they are licensed for fifty but have ó2 enrolled and they could take my three. I am the one that noticed the padlock on the bus, if they cannot make that door stay closed or whatever their reason is, then they should not be hauling children in it. I do work everyday and when I come home at five or five fifteen, there is a problem on Crestmont. There is a need for good Day Care. I was not impressed with what I saw. Johnson: Thank you. Prior to this, I had visited another day care center in Meridian and was very discouraged at the condition of that particular center and the future of where I could find satisfactory care for my daughter. I became aware of Inchworm daycare from observing their sign on Cherry Lane. I decided to visit. Immediately I was impressed with the cleanliness of Inchworm and the small but organized surroundings. I was politely given a tour that day by Kathe and provided with answers to my questions and concerns. Also I was provided with references to call. After several telephone calls I had the impression that I had made a good choice. Still a time like this is very frightening for a parent. With those good reviews, I began taking my daughter but still with much uneasiness as I needed to be convinced myself that my daughter was being provided with the best care possible. After several weeks my apprehensions were cleared. My wife and I are very confident in the care that the staff at Inchworm daycare are providing. We now have our son going there as well and both children enjoy the center and have never complained of any trouble. I hope that you give much consideration to the requests on Inchworm daycare. Another possibility might be to look at drawing zones around Meridian, the. further you go out the more those would be for Meridian. I think we're being, for the lack of a "better-word, had a little bit in terms of the industrial and commercial development. I'd like ,very much if the Commissioner's would re-examine that ordinance.____/.------ Sal"es: The Ordinance itself calls for re-examination of the formula on an annual basis beginning prior to December 31, 1993. We're still testing all of th~se .so I don't know when we will start that first revision, but yes we look at the formula. There's another thing in your favor also, the primary connection between Meridian and the other town over there are Federal and State Highways which do enter into the calculation. The calculation tries to,calculate the amount of traffic that uses county roads as opposed to State and Federal Highways. ,..-------" Kingsford: That's a very valid point. Crookston: I have a question for my own information. Something came up about not having enough stub roads and access into other subdivisions. Just as a point of interest, does ACHD look out for that? Is there anyone Guy Walker, 9119 Austin, Boise, was sworn by the attorney. Walker: With all due respect to the Planning and Zoning and their recommendation for denial of the rezone and Conditional Use Permit for this facility I would like to address the two pertinent issues of the Findings of Facts and Conclusions. First, the fact being that the City, as you area aware, is within its legal authority to grant the rezone and conditional use permit as noted in the Facts and Findings. The second issue is regarding the conclusion of the Findings of the Planning and Zoning. It is regarding the alternate parking and traffic patterns were presented which I believe regretfully have caused confusion as to the development of the property. We received information from ACHD with regard to their recommendations as to traffic patterns and just the day before the meeting and so we had very little time to prepare the alternates and so forth. Therefore, I felt it was a little bit confusing to the Planning and Zoning. Therefore, I've provided you with a more detai led plan of development of the property of which was one of 8 8 MERIDIAN CITY COUNCIL SEPT. 15, 1<:)92 PAGE 9 \ the alternates and with the suggestions of Gary Smith and Larry Sales of ACHD should the City grant the rezone and conditional use permit. <Further explanation - see tape) There was not one property owner within the required distance objected to this facility. Explained project. The playground area would be in front with a six foot chain link fence with no gat~s. The existing,hedge goes clear out to the street and presently creates a hazard for us to be able to exit from that driveway out onto Cherry Lane. We are proposing to move that hedge and cut it back at least to be lined with the house or even with the pleasure of the City Council we could remove the hedge completely and install a wood fence that would have the proper set-backs. ExplaiDed improvements further. We are requesting that the City Council give this consideration for approval for the Conditional Use Permit and rezone. She does run a very nice business. Kingsford: Anyone else to testify? Pat Fuj i i, 4345 Pasadena Drive, was sworn by the attorney. Fujii: Thanked City Council for concern and following through on a previous irrigation problem. My husband and I own the rental next door to this proposed project. As Mr. Walker said we did want a six foot fence to keep that high hedge between us. How old are the children? Walker: Infant up to two. Fujii: Explained concerns about having a chain link fence. I would rather have a complete fence all the way around. I would like them to make clear to the parents of the children in the day care that our asphalt is not a parking ar~a for them. Like we have stated before, we do have a machinery coming in and out of that area and it could become very dangerous. Tolsma: The hedge separates your property? Fujii: Yes. Tolsma: But you would prefer that the hedge be left there. Fujii: If it's kept nicely and taken care of. Davlin: My property is about 10 foot from the Inchworm Day Care that is presently operati.ng. I have had a couple problems. The building started at this site at 6:30 A.M. on a Saturday morning, I called Linda Paddock and she agreed it was a little early. She did call off the construction for awhile. The first year I noticed a child on the roof, I called over and was told it was her grandson. They have two school buses, one of the buses has a padlock on the emergency exit door. The parking lot is not always working. I notice people pulling up in front on Crestmont to drop their children off. That is supposed to be for the employee parking. When I heard they were applying for another Day Care, I went over and took a tour and at that time I was told they were licensed for 50 children.
