Mark – UDC Table 11-2B-2, Allowed Uses in Commercial Districts, lists drive-through establishments as “A/C” (accessory use/conditional use) with a reference to the specific use standards listed in UDC 11-4-3-11 for Drive-Through Establishments. A drive-through is only an accessory use where none of the provisions noted in 11-4-3-11A apply. In this case, the use is within 300’ of a residential district & residential use; therefore, a CUP is required. The sign posting requirements in UDC 11-5A-6 state an 18” x 24” sign may be posted for a CUP for a group daycare only, all others must be posted with a 4’ x 4’ sign meeting the requirements in UDC 11-5A-6D.2b. See attached for the request for continuance. 1 The 4x4 sign seems excessive (and expensive) for this project for menu and food pickup windows as previously discussed. The highlighted code section below appears to be viable to conditional use, and if it’s not, it’s quite misleading. Let me know if you’d agree to an 18x24 sign instead, thank you. Conditional use permit applications for daycare, group; city council review of accessory uses in residential districts; and annexation, preliminary plat, variance, rezone, and comprehensive plan amendment applications for properties of land less than two (2) acres in size: The applicant shall post a sign consisting of one (1) 18-inch by 24-inch piece of paper mounted to a rigid surface of at least equal size, or other material stating the name of the applicant, a statement concerning the proposed development, and the date, time and location of the public hearing. Can we do a 18x24 sign in lieu of a 4x4 sign as the new proposed drive-through is accessory use adjacent to a residential district (per UDC 11-4-3-11)? Let me know, thanks.
