All, We have thoroughly reviewed the staff report for TM Center – PP and Ten Mile Crossing – MDA, RZ and concur with staff’s recommendation for approval found on page 26 of the staff report, as follows: “Staff recommends approval of the requested modification to replace all existing Development Agreements with a new agreement for the overall Ten Mile Crossing development per the provisions in Section IX.A.1; approval of the proposed rezone in accord with the Findings in Section X; and approval of the proposed preliminary plat per the conditions included in Section IX in accord with the Findings in Section X.” However, we take exception with Staff’s characterizations on page 21 of the report that “the applicant was not in favor of…” staff suggestions. In fact, for more than a year we worked with, and followed staff’s suggestions for a PUD/Sub Area plan overlay of the TMISAP as the means to accomplish our development objectives. At 3:10 PM on Christmas Eve, 2020, staff informed us of a “re-direction.” Rather than the mutually-agreed-upon PUD Sub Area Plan Overlay, it was recommended that the application be modified to a Master Development Agreement with Design Guidelines, i.e., a refinement of the document developed over 9 months and reviewed twice with staff. To re-state . . . We concur with staff’s recommendation for approval: - Of the Ten Mile Crossing DA Modification with the proposed Design Guidelines; - Of the proposed rezones; and - Of the TM Center Subdivision preliminary plat. However . . . We have concerns with some of the recommended conditions, thus; - We request modifications to the Conditions of Approval per the first 9-page attachment (high-lighted, exact copies of staff report pages 48 – 56). - The proposed modifications achieve the direction of staff leadership for a Master DA/Design Guidelines to supersede the TMISAP as the guide for development of Ten Mile Crossing. As requested . . . - A Ten Mile Crossing Conceptual Land Use Plan—the 2nd attachment—has been provided to assist the Commission and Council in understanding the overall development objectives of the 308-acre project. Finally . . . On behalf of Brighton et al, we respectfully request an affirmative recommendation from the Commission to Council for approval of the applications with the proposed conditions modifications. 2 Michael D.
