Idaho Administrative Code 39.03.42 ("IDAPA") governs permit applications, denials, and the appeals process relating to
encroachment permits.The Idaho Transportation Department (ITD) may issue encroachment permits to allow property
owners to access the state highway system. IDAPA 39.03.42.100.01(a) and 39.03.42.300.01. However, in order for a
permit to be issued, a requested approach must meet ITD's access control criteria. IDAPA 39.03.42.300.01. If the
requested approach does not meet criteria for safety and highway operations, access control and/or other concerns,
then the permit may be denied. IDAPA 39.03.42.400.03.The District is required to consider various factors in reviewing
an encroachment permit. Such factors include current access control, design standards, safety and long-range planning
goals, among others. IDAPA 39.03.42.200.09.
Upon review of your permit application and in consideration of the relevant regulations,the permit application for
encroachment into ITD's right-of-way and subsequent connection within ITD's right-of-way to Serenity Lane, a private
driveway, on US 20/26 near milepost 34.544(right)to the proposed Prescott Ridge Medical Campus has been denied
by the Idaho Transportation Department.
Basis for Denial:
The proposed access connection onto Serenity Lane within ITD's right-of-way is only 90ft from the existing US 20/26
edge line for eastbound thru traffic. At full buildout of the US 20/26 corridor, this distance would be reduced to 65ft.
In either condition, this minimal separation distance poses significant safety concerns with vehicular turning
movements, congestion and pedestrian conflicts at both the Serenity Lane and US 20/26 intersection and the proposed
driveway and Serenity Lane intersection. Per ACHD Policy Manual Section 7207.4.1, the proposed private road should
be offset a minimum of 150ft from an arterial roadway intersection, US 20/26.

ITD has already bought the necessary right-of-way on this segment of the US 20/26 corridor to preserve for the future
interchange at the intersection of SH-16 and US 20/26.The right-of-way must accommodate the interchange, future
drainage needs and a 10ft pedestrian pathway. Per the Federal Highway Administration (FHWA), any deviation from
the federally approved US 20/26 Corridor Plan will result in the need for a re-evaluation of the study with respect to
the impacted features.Allowing the driveway to encroach into ITD's right-of-way will require adjustments to the
drainage and pedestrian pathways features.
The permit application identified that the proposed encroachment into ITD's right-of-way is needed to meet the
requirements of Meridian's Community Development Department Staff Report dated January 21,2021 that the
development provide a frontage road. ITD has spoken with Meridian planning department staff,they presented a
layout that shows the developments driveway connection to be completely outside of ITD's right-of-way. Meridian
staff stated they did not require encroachment into ITD's right-of-way as part of the staff report.
Administrative Remedies:
As a result of this denial,you have the option to appeal this denial in accordance with IDAPA 39.03.42.200.13, Idaho
Rules of Administrative Procedure of the Attorney General.
Pursuant to ITD Administrative Decision 5025,the appeal process is a two-step process. First,the written appeal is
directed to the District Engineer who shall have 30 working days to review the appeal.

sent to you via certified mail within 7 days of the ruling. IDAPA 39.03.42.003.03. If the District Engineer does not
overturn the denial,you will have 21 days from the date of the District Engineer's decision to submit a written request

hearing will be scheduled.The administrative hearing officer will preside over the hearing, pursuant to Idaho
Transportation Department, Administrative Policy, 5025 and Idaho Transportation Department Board Policy 4025.The
administrative hearing officer will contact you and ITD to discuss this matter, schedule a hearing date, and request
whatever documentation he believes is necessary. After the administrative hearing, the hearing officer shall issue
findings of fact, conclusions of law and a recommended order to the Director of ITD.The Director of ITD shall review

Work Description: Permit one joint use approach for subdivision and medical center access.
Email permit number and route start date request a minimum 5 business days in advance to the above ITD
contact. Email correspondence shall reference the permit number in the subject line. Keep email of approved
start date onsite with permit. If needed, request to meet on-site to review the project and permit
requirements.
• Submit material certification prior to placement.
• Submit Mix designs for asphalt/concrete, if applicable, 14 days in advance to ITD for review and
approval.
• It is expected that the traffic control will be set up per the approved traffic control plan to ensure both
public and workers safety. In the event an inspection is done and the traffic control setup does not
meet the approved traffic control plan, the permit holder will be asked to fix the discrepancies. If the
permit holder fixes the traffic control, this will be considered a warning. If another inspection happens
and the traffic control setup does not meet the approved traffic control plan again, the permit will be
pulled until a meeting can be held with all parties to fix the discrepancies. Possible discussion points at
the meeting would be what steps the permit holder will do to ensure the discrepancies will not happen
again, and possibly what, if any, funds will need to be added to the permit to cover additional permit
inspection costs. If required, the inspection costs could be as much as $400 per week.

• Prepare all required documentation, including As-Built submittals.
• Send a notification email to the ITD Foreman that work is complete and schedule to meet on-site for
inspection, all documentation must be available for inspection, list permit number on each sheet.

General Requirements ITD Permit Application Number
1. The original permit or a copy must be kept on the job site whenever work is taking place.
2. No work shall commence until the permittee is given notice to proceed by an authorized representative of ITD. The permittee
shall notify ITD five(5)working days prior to commencing the permitted work if work does not commence immediately upon
notice by ITD.
3. During the progress of all work, traffic control devices shall be erected and maintained as necessary or as directed All traffic
control devices shall conform to the most current edition of the Manual on Uniform Traffic Control Devices for Streets and
Highways, as adopted by the State. Equipment or materials left within the Highway Right-of-Way when work is not taking
place shall be delineated and protected with appropriate approved traffic control devices.
4 All work within the State Highway Right-of-Way shall comply with the requirements of the ITD Workzone Safety and Mobility
Policy. Copies available from ITD upon request.
5. All work herein permitted shall conform to current government and industry standards, including Americans with Disabilities
Act, and shall be performed and completed to the satisfaction of ITD. The expense of any required supervision of work
performed under this permit shall be borne by the permittee.
6 Work done under this permit shall be constructed in a manner that shall not cause water to flow onto the roadway or shoulder,
and shall not interfere with the existing drainage on the State Highway System or any adjacent drainage system.
7. All utilities shall be installed under culverts.
8. The permittee shall furnish all material, labor, and equipment involved in the construction of the approach and its
appurtenances. This shall include furnishing drainage pipe, curb, gutter, concrete sidewalk, etc., where required.
9. ITD may inspect the materials and workmanship during construction and upon completion to determine that all terms and
conditions of the permit are met. Inspectors are authorized to enforce the conditions of the permit during construction and to
halt any activities within state Right-of-Way that do not comply with the provisions of the permit, that conflict with concurrent
highway construction or maintenance work, and/or that endanger highway property, natural or cultural resources protected by
law, or the health and safety of workers or the public.
10. ITD shall be reimbursed by the permittee for any additional inspection required to insure compliance with the conditions of this
permit. Inspection fees will be based upon inspection time including travel from the ITD facility and charged at rates
commensurate with industry standards.
11. Upon completion of the permitted work, any disturbance of the highway, Right-of-Way, and/or traffic control devices shall be
restored to the satisfaction of ITD including the removal of all rubbish and debris and may include seeding, planting and
grading.
12. Any encroachment that is found to be in non-compliance with the terms of the approved permit may be required to be
modified, relocated, or removed at the sole expense of the permittee upon written notification by the District Engineer or his
authorized representative.
13. The permittee shall maintain at its sole expense the encroachment for which this permit is granted.
14. Changes in the use as defined in I.D.A.P.A. 39.03.42, of the permitted access not consistent with the terms and conditions
listed on the permit may be considered a violation of the permit. Any modification, relocation, or removal of an encroachment
or subject granted by this permit shall require a new permit prior to commencement of such work.
15. ITD may revoke, amend, amplify, or terminate this permit or any of the conditions herein enumerated if the permittee fails to
comply with any or all of its provisions, requirements, or regulations as herein set forth or through willful or unreasonable
neglect, fails to heed or comply with notices given, or if the approach, structure, or subject herein granted is not installed or
operated and maintained in conformity herewith.

6. Transportation Impact Study (TIS). Details regarding the required contents of a TIS are available from the District Permits
Coordinator or District Traffic Engineer after your application is received:
a. ITD will review the application for completness. The application will then be discussed internally with staff. Your request
may be approved, approved with conditions, or denied. If there are any unusual conditions that need to be met, ITD will
contact you in advance.
b. Once the application is approved and signed by ITD, the application becomes your permit to begin work. ITD will send
your approved permit by email and the original by USPS.
i. All work under the permit shall be completed within one year from the date that the Department issues the permit to
begin work. Applicant may request, in writing, one, 6 month extension prior to expiration of the permit. For large
developments the ITD District Engineer may, at their discretion, extend the expiration date.
ii. If permittee does not agree with all conditions in the approved permit they may send a written notice to ITD to cancel
the permit or negotiate new terms.
iii. All permitted work shall be completed and available for final inspection within thirty (30) days after construction
begins, unless otherwise stated in the special provisions of the permit.
iv. After construction is completed you must notify the ITD Maintenance Foreman for final inspection of the permitted
work. The contact information for the foreman will be included in your permit package.
V. Permit will be considered temporary until final approval by the ITD.
vi. Failure to complete all work in accordance with the requirements of the permit and receive final approval within the
allotted time will render the permit null and void.
vii. Only Changes in deeded access will be recorded with the County following the final approval by ITD. You will receive
a copy of the recorded document which should be retained for future reference.
c. If your application is denied, you will be notified by certified mail. The reason(s) for the denial and the process for
appealing the denial will be outlined in the letter you receive
7. If your application is approved, your signature indicates you understand the following:
a. Approaches shall be for the bona fide purpose of securing access and not for parking, conducting business, or servicing
vehicles on the Highway Right-of-Way. A list of all prohibited uses of ITD Right-of-Way is available in I.D.A.P.A. 39.03.42,
b. Any permit or privilege granted under an ITD 2109 shall not be deemed or held to be an exclusive one and shall not
prohibit the state from using any of its highways, streets, or public places or affect its right to full supervision and control
over all or any part of them. ITD reserves the right to add, remove, modify, repair, or relocate any encroachment(s) or
appurtenance(s)within the Highway Right-of-Way which currently exists or has been authorized by this permit, to
accomplish the relocation, reconstruction, widening, or maintenance of the highway and/or to improve safety or mobility on
or adjacent to the highway system.
c. Any traffic control features or devices in the State Highway Right-of-Way, such as islands, median openings, traffic
signals, illumination, and other traffic control devices required as a condition of a permit, are not an integral part of the
approach authorized by the permit and as such shall become property of the State upon final inspection and approval by
ITD. ITD reserves the right to change these features and devices in the future in order to promote safety and/or mobility
within the State Highway Right-of-Way. Expenditure of monies for purchase or installation of said features or devices
shall not create an ownership interest in the features or devices.

1. Use one form for each requested approach. The form initially serves as an application for a connection between an
adjacent property and a state highway. If approved, the completed form becomes a permit for the state highway
connection.
2 Please print(in ink), type, or complete the application in Microsoft Word and print the form.
3. Read and understand these instructions and all of the General Requirements on the form. These requirements apply
to all approach permits and if you are granted a permit; you must adhere to each of them. Additional permit-specific
provisions may be a part of any approved permit, and you will be given the opportunity to review them prior to
accepting your permit.
4. Complete each item in the shaded area under"Applicant Information" and "Request Details."
5. Include the following with your application:
a. Non-refundable application fee (ranges from $50-$100 - please confirm the applicable amount with ITD).
b. A copy of the latest deed of record which identifies the property owner and provides the legal description of the
property abutting the State Highway Right-of-Way where the proposed access is being requested. If ownership of
the property changes during the permit process, a new form must be submitted with the new ownership
documentation.
c. Photographs of the proposed driveway location, including one looking each direction along the highway from the
proposed location. Digital photographs are acceptable.
d. Plans or drawings as follows:
i. For agricultural, single-family, or joint-use approaches, include an 8 '/2" x 11" or 11" x 17" drawing showing the
location of the proposed access on your property which is shown in relation to property lines, highway,
existing and proposed buildings. A second drawing or map should be included that shows the location of your
property in relation to other roads and landmarks. Show all dimensions, mark which direction is north and if
possible, draw to scale. Include copies of any easements or agreements with adjacent property owners.
ii. For commercial, multi-family, subdivision, or public street approaches, include a site/plot plan, grading and
drainage plans Show the parcel layout, proposed lots, dimensions, north arrow, building locations and sizes,
parking, internal drive aisles, street layouts, etc. A second drawing or map should be included that shows the
location of your property in relation to other roads and landmarks. Show all dimensions, drawn to scale.
Include copies of any easements or agreements with adjacent property owners.
e. Unless the requirement is waived by the District Engineer, a Traffic Impact Study shall also be required when a
new or expanded development seeks direct access to a state highway, and at full build out will generate one
hundred (100) or more new trips during the peak hour, the new volume of trips will equal or exceed one thousand
(1000)vehicles per day, or the new vehicle volume will result from development that equals or exceeds the
threshold values in Table 2. The Traffic Impact Study is created by a licensed engineered in the State of Idaho at
their cost.

NOTE: This project was previously heard by the Commission on October 22"d of last year; a
recommendation of approval was forwarded on to the Council. At the December P
hearing, the Council proved to remand the project back to the Commission jar the out-
parcel at the northeast corner of the site adjacent to the commercial development to be

Developments along SH 2O-26 are required to construct a street generally paralleling the state
highway that is no closer than 660 linear feet(measured from centerline to centerline)from the
intersection (i.e.Rustic Oak)with the state highway. The purpose of which is to provide future
connectivity and access to all properties fronting the state highway that lie between the subject
property and the nearest section line road and/or half mile collector road. The street shall be
designed in accord with the standards set forth in UDC 11-3H-4B.3 and shall collect and
distribute traffic.Frontage streets or private streets may be considered by the council at the
time of property annexation or through the conditional use process.Frontage streets and
private streets shall be limited to areas where there is sufficient access to surrounding
properties and a public street is not desirable in that location.
A frontage road is proposed along the northern boundary of the site adjacent to Chinden Blvd.
with an access on Rustic Oak approximately 660' south of Chinden as depicted on the
conceptual development plan in Section VIII.A.Because residential homes exist to the west
that are not likely to redevelop in the near future, a future interchange for SH-16 is planned
east of the McDermott/Chinden intersection, and a north/south collector street(Rustic Oak)
exists along the east boundary of this site, Staff believes there is sufficient access to
surrounding properties as proposed without the provision of a public street.
Emergency access:In response to the Fire Department's estimated response time to the
development, which are below the target goal on the McDermott side of'the subdivision, the
Applicant plans to include an AED (Automated External Defibrillator) device in the clubhouse and
provide education related to the use of the device to ensure residents are aware of the benefits and
function if the device is needed. Additionally, a connection is proposed from Chinden through the
project to the southern boundary of the subdivision with the first phase of development to aid in
emergency response times to the site; this should also benefit response times to The Oaks North to
the south.
Parking(UDC 11-3C'1:
Off-street parking is required to be provided for residential uses in accord with the standards listed
in UDC Table 11-3C-6; and for non-residential uses in accord with the standards listed in 11-3C-
6B.1. Future development should comply with these standards. A parking exhibit(and details in the
narrative)was submitted with this application, included in Section VIII.F that depicts 46 15 extra
off-street parking spaces in the townhome portion of the development and a total of 505 497 on-
street parking spaces available for guest parking. A total of 16 off-street parking spaces are
proposed for the 3,750+/- square foot clubhouse and swimming pool facility. Staff is of the opinion
the proposed parking in the single-family and townhomes portions of the development should meet
the parking needs. Off-street parking in the multi-family portion of the development will be
evaluated with the conditional use permit application.
Off-Street park ng is required to be provided for the comiercial portion of the development in
accord with the standards listed in UDC 11-3C-6B for commercial uses with the exception of
restaurant uses: off-street parking for restaurant uses is required per the standards listed in UDC II-
4-3-49. Ott-street parking is depicted on the conceptual Master Plan in accord with these standards
and wil! reviewed again with the final design of the site to ensure consistency with these standards.
Pathways (UDC 11-3A-8):
The Pathways Master Plan depicts segments of the City's multi-use pathway system across this site.
In accord with the Plan, the Park's Dept. recommends detached 10' wide multi-use pathways are
provided within the street buffers in the following locations: along N. McDermott Rd., W. Chinden
Blvd./SH 2O-26, the east side of N. Rustic Oak Way from Chinden to the southern boundary of the
site, and along W. Ramblin St. from Rustic Oak to the school site. These pathways are required to
be placed in a 14-foot wide public pedestrian easement.

2. Administrative design review shall be required for all single-family attached,
townhome and multi-family structures. Compliance with the design standards
for such listed in the Architectural Standards Manual is required.
3. The rear and/or side of structures on Lots 2-6, Block 4; Lots 2-7, Block 1; Lots 8 and 9-
15, Block 9; Lot 16, Block 7; Lot 2, Block 12; Lots 2-14, Block 10;Lots 2-16 and 29,
Block 14; Lot 68, 70, 81-83, and 77-78, Block 12; and Lots 43 44,-75 42, 45 and 79 67,
Block 8 that face collector streets (i.e.N. McDermott Rd.,N. Rustic Oak Way and W.
Ramblin St.), shall incorporate articulation through changes in two or more of the
following: modulation(e.g. projections, recesses, step-backs, pop-outs), bays, banding,
porches, balconies,material types, or other integrated architectural elements to break up
monotonous wall planes and roof lines that are visible from the subject public street.
Single-stofy structures are exemptfrom this requirement.
4. A conditional use permit shall be obtained for a multi-family development in
the R-15 zoning district as set forth in UDC Table 11-2A-2. The use is
subject to the specific use standards listed in UDC 11-4-3-27: Multi-Family
Development.
5. One management company shall handle the leasing and maintenance of the entire multi-
family development to ensure better overall consistent management of the development.
6. An electronic gate that is approved by the Fire Department shall be}provided for access
to Serenity Ln. from (lie south,
7. Noise abatement for the future SH-16 extension sliall be provided in the form of a berni
or a berm and wall combination parallel to N. McDermott Rd. constructed in accord

b. Medical campus/hospital:
1. Future development of this site shall be generally consistent with the master
plan,preliminary plat,phasing plan, landscape plan and conceptual building
elevation included in Section VIII and the provisions contained herein.
2. Future development shall comply with the design standards listed in UDC 11-3A-19
and in the Architectural Standards Manual.
3. Noise abatement shall be provided in the form of a berm or a berm and wall
combination parallel to W. Chinden Blvd./SH 2O-26 constructed in accord with the
standards listed in UDC 11-3H-4D.
4. A minimum 30-foot wide buffer with an 8-foot tall CMU wall shall be provided along
the western and southern boundaries of the site adjacent to residential uses as proposed
on the landscape plan in Section VIII.D. Dense landscaping consisting of a mix of
evergreen and deciduous trees, shrubs, lawn or other vegetative ground cover that
results in a barrier that allows trees to touch at maturity is required per the standards
listed in UDC 11-3B-9C. The block wall shall be decorative and have texture and a
color complimentary to adjacent residential structures—plain CMU block is not
allowed.
5. A frontage road parallel to W. Chinden Blvd./SH 2O-26 shall be constructed as depicted
on the conceptual development plan in Section VIII.A in accord with UDC 11-3H-
4B.3e.
6. The hospital_building_shall be restricted to 3-stories in height as proposed.
