Conditional Use Permit
Dear Sonya,
Attached to this letter is a Conditional Use Permit application for 1.18-acres along Eagle Road, south of
Ustick on the west side of Eagle Road. (Please note the application does not include the 3.29 acres on
the corner.)

The property is parcel S1105110120, zoned C-G, and is not adjacent to residential uses. Uses to the north
include commercial pad sites; south include a multi-tenant building with a mix of retail, personal service,
and a drive-thru restaurant; east is Eagle Road and a commercial shopping center; and west includes the
planned VillaSport athletic club.
The applicant respectfully requests a Conditional Use Permit for a drive thru use in an approximately
7,555 SF multi-tenant building. The drive thru is proposed for a coffee shop/restaurant on the north
end of the building.
An existing drive-thru for Jimmy Johns exists to the south of the property. A drive-thru for a restaurant
use is planned to the north as part of a multi-tenant building. The proximity to both of those drive-thru
uses is less than 300'therefore a CUP is required for this use.

A traffic study was prepared by Kittleson for a 14,000 SF retail use on this property as part of the
VillaSport project. Access to the site is via internal driveways and cross access agreements Ustick Road
and indirectly to Eagle Road via Cajun Lane and Seville Lane.
The site has been designed with ample stacking, an escape lane, and pedestrian access across the drive
thru lane.
