There were several reasons we did not provide a public street connection from the end of the cul-de-sac to E. Shafer
View Road. The reasons are outlined below:
Shafer View Estates residences presented strong opposition to the connection to Shafer View Road.
A public road through this area cannot be designed without modifications to the Mc Birney lateral which is
under the jurisdiction of the Bureau of Reclamation (BOR). The approval process for modifications to their canal
and an encroachment on their easement is very time consuming (we estimate up to 12 months) with no
guarantee of approval. They don’t even want us to landscape in their easement and the road would be a much
bigger impact.
In addition to approval from the BOR we would need to get approval from the Nampa-Kuna Irrigation District
because they have irrigation piping located in this area as well.
A public road through this area would also require a new pump system for the Shafer View Estates irrigation
system as the road would go through the existing pump system. Moving of the pump system would also require
moving/modifying a large BOR irrigation pipe that feeds the irrigation pump station.
The cost of design and irrigation infrastructure work required to put a public road between the cul-de-sac and E.
Shafer View Road is estimated to be $100,000 to $150,000.
Requiring a public road connecting the cul-de-sac to Shafer View Road would create significant time delays an undue
financial hardship for our client, possibly resulting in an unviable project. In lieu of the full roadway we will be providing
an emergency access that can be used in an emergency.

where the emergency access is proposed please. This property owns the land to the Shafer View Rd. ROW, right?
