Broadway Avenue Meridian, ID 83642 RE: Baraya Subdivision No. 5 (H-2020-0088) Final Plat Modification—Condition 5b.—Purdham Drain Fencing Honorable Mayor and City Council Members: On behalf of Schultz Development,LLC and Challenger Development, Inc, please accept this final plat modification request for the Baraya Subdivision No. 5 final plat approved at City Council on October 13, 2020. We are requesting the deletion of Planning Condition 5(b). which states: Depict fencing between the multi-use pathway and the Purdham Drain as proposed by the applicant and depicted on the landscape plan approved with the preliminary plat. The Baraya Subdivision preliminary plat and accompanying preliminary landscape plan were approved on July 10, 2007 (PP-06-062). We believe the depiction of parallel fencing between the Purdham Drain and the 10' multi-use pathway was an error by our landscape consultant that was overlooked at the time and also with the construction of Baraya Phase 1 in 2016 and Baraya Phase 4 in 2019. Fencing between the pathway and drain were not constructed on those phases. Since the original preliminary plat was approved in 2007, all regional pathways constructed by other developments adjacent to natural drains and creeks such as the Purdham Drain and Ten Mile Creek are not required to install the parallel fencing. However, parallel fencing for public safety is required adjacent to delivery canals to keep people away from the deep, cold, and fast water of those structures that are often concrete-lined and difficult to climb out of. The Purdham. Drain is a shallow, natural seasonal waterway with wildlife and aquatic vegetation that is not fenced off by other developments with adjacent multi-use pathways such as Ten Mile Crossing upstream. A similar waterway would be the Ten Mile Creek with several developments with adjacent multi-use pathway and the waterway is not fenced off. Sincer y, Matt Schultz Schultz Development LLC
