RECITALS 1.2 WHEREAS, I.C. $ 67-651 I A, Idaho Code, provides that cities may, by ordinance, require or permit as a condition of re-zoning that the Owner/Developer make a written commitment concerning the use or development of the subject Property; and 1.3 WHEREAS, City has exercised its statutory authority by the enactment of Ordinance ll-5B-3, which authorizes development agreements upon the annexation and/or re-zoning of land; and 1.4 WHEREAS, Owner/Developer has submitted an application for re- zoning of the Propeny's descnbed in Exhibit A, and has requested a designation of C-N, Neighborhood Business District and L-O. Limited Office District (Municipal Code of the City of Meridian)l and 1.5 WHEREAS, Owner/Developer made representations at the public hearings both before the Meridian Planning & Zoning Commission and before the Meridian City Council, as to how the subject Property will be developed and what improvements will be made; and I .6 WHEREAS, record of the proceedings for the requested annexation and zoning designation of the subject Property held before the DEVELoPMENTACREEMENT(RZ0r3irJ.ri'"rr"r.-wERCRossrNccoMMERCrAL ADA COUTITY RECOROER J. DAVID I{AVARRO IMOUIfi .OO 55 WHEREAS, Owner/Developer is the sole owner, in law and/or equity, of certain tract of land in the County of Ada, State of ldaho, described in Exhibit A for each owner, which is attached hereto and by this reference incorporated herein as if set fbrth in full, herein after referred to as the Propenyl and t. Lt 1.1 Planning & Zoning Commission, and subsequently before the City Council, include responses of government subdivisions providing services within the City of Meridian planning jurisdiction, and received further testimony and comment; and WHEREAS, City Council, the l8th day of March, 2008, has approved the City of Meridian Planning Department Staff Repon, set fonh in Exhibit B, which are attached hereto and by this reference incorporated herein as if set forth in full, hereinafter ret'erred to as (the Findings): and OWNER/DEVELOPER deem it to be in their best interest to be able to enter into this Agreement and acknowledges that this Agreement was entered into voluntarily and at their urging and requests; and 1.9 I .10 WHEREAS, City requires the Owner/Developer to enter into a development agreement for the purpose of ensuring that the Property is developed and the subsequent use of the Property is in accordance with the terms and conditions of this development agreement, herein being established as a result of evidence received by the City in the proceedings for zoning designation from government subdivisions providing services within the planning jurisdiction and from affected property owners and to ensure re-zoning designation is in accordance with the amended Comprehensive Plan of the City of Meridian adopted August 6, 2002, Resolution No.02-382, and the Zoning and Development Ordinances codified in Meridian Unified Development Code. Title ll. NOW, THEREFORE, in consideration of the covenants and conditions set fbnh herein, the panies agree as follows: 2. INCORPORATION OF RECITALS: That the above recitals are contractual and binding and are incorporated herein as if set forth in full. 3. DEFINITIONS: For all purposes of this Agreement the following words, tems, and phrases herein contained in this section shall be defined and interpreted as herein provided for, unless the clear context of the presentation of the same requires otherwise: DEVELOPMENT AGREEMENT (RZ 07-022) BRIDGETOWER CROSSING COMMERCIAL PACE 2 OF 9 I .8 WHEREAS, the Staff Report requires the Owner/Developer to enter into a development agreement before the City Council takes final action on annexation and zoning designation; and 3.1 CITY: means and refers to the City of Meridian, a party to this Agreement, which is a municipal Corporation and government subdivision of the state of Idaho, organized and existing by virtue of law of the State of ldaho, whose address is 33 East Idaho Avenue, Meridian, Idaho 83642. 3.2 OWNER/DEVELOPER: means and refers to Primeland Development Company, LLC, whose address is 3120 W. Belltower, Meridian, Idaho 83646, the party that owns and is developing said Property and shall include any subsequent owner(s) or developer(s) of the Property. 3.3 PROPERTY: means and refers to that certain parcel(s) of Property located in the County of Ada, City of Meridian as described in Exhibit A describing the parcels to be re-zoned C-N, Neighborhood Business District and L-O, Limited Office District, attached hereto and by this reference incorporated herein as if set forth at length. USES PERMITTED BY THIS AGREEMENT: 4.1 The uses allowed pursuant to this Agreement are only those uses allowed under City's Zoning Ordinance codified at Meridian Unified Development Code $ l1-2B which are herein specified as follows: Preliminary Plat of 8 commercial buildings and I other lot tn the proposed C-N and L-O zones on 13.25 acres. The pertinent provisions of the City of Merilian Comprehensive Plan are applicable to this RZ 07-022 application. 4.2 No change in the uses specified in this Agreement shall be allowed without modification of this Agreement. 5. CONDITIONS GOVERNING DEVELOPMENT OF SUBJECT PROPERTY: 5.1 Owner/Developer shall develop the Property in accordance with the following special conditions: The proposed commercial and ofTice buildings shall be constructed with high quality materials, including but not limited to: stucco, wood and brick, with substantial stone accents, four sided architecture: for retail uses one side may not require full fagade treatment if there is screening for the loading area., highlighted main entrances, stamped decorative concrete, flat roofs, accent metal DEVELOPMENT AOREEMENT (RZ 07-022) BRIDGETOWER CROSSING COMMERCIAL PAGE 3 OF 9 4. rooflng, composite or tile roofing materials and variations in colors, roof planes and parapet heights. 2. Elevations shall substantially conform to the photos submitted with MI-07-014, as set forth in Exhibit D. 3. Development of the property shall generally comply, as determined by the Planning Director, a minimum of 2 buildings with no one building exceeding 33,725 square feet shall be constructed on lots associated with the Bridgetower Crossing Commercial Subdivision. The maximum allowable non-residential square footage for this development shall be 90,000 square feet. 4. The development of the site shall generally conform to the concept plan l, 3 or any combination of I and 3 in Exhibit C. 5. The City Council expects some stamped decorative concrete within the proposed development. 6. COMPLIANCE PERIOD/CONSENT TO REZONE: This Agreementand the commitments contained herein shall be terminated, and the zoning designation reversed, upon a default ofthe Owner/Developer or Owner's/Developer's heirs, successors, assigns, to comply with Section 5 entitled "Conditions Governing Development of Subject Propeny" of this agreement within two years ofthe date this Agreement is effective, and after the City has complied with the notice and hearing procedures as outlined in Idaho Code $ 67-6509, or any subsequent amendments or recodifications thereof. Owner/Developer consent upon default to the reversal of the zoning designation of the Property subject to and conditioned upon the following conditions precedent to-wit: 1.1 That the City provide written notice of any failure to comply with this Agreement to Owner/Developer and if the Owner/Developer fails to cure such failure within six (6) months of such notice. DEFAULT: 9.1 In the event. Owner/Developer, or Owner's/Developer's heirs, successors, assigns, or subsequent owners ofthe Property or any other DEVELOPMENT AGREEMENT (RZ 07-022) BRIDGETOWER CROSSING COMMERCIAL PAGE 4 OF 9 9 1. CONSENT TO DE-ANNEXATION AND REVERSAL OF ZONING DESIGNATION: 8. INSPECTION: Owner/Developer shall, immediately upon completion of any portion or the entirety of said development of the Property as required by this agreement or by City ordinance or policy, notify the City Engineer and request the City Engineer's inspections and written approval of such completed improvements or portion thereof in accordance with the terms and conditions of this Development Agreement and all other ordinances of the City that apply to said Development. person acquiring an interest in the Property, fail to faithfully comply with all of the terms and conditions included in this Agreement in connection with the Propeny, this Agreement may be modified or terminated by the City upon compliance with the requirements of the Zoning Ordinance. 92 A waiver by City of any default by Owner/Developer of any one or more of the covenants or conditions hereof shall apply solely to the breach and breaches waived and shall not bar any other rights or remedies of City or apply to any subsequent breach of any such or other covenants and conditions. 10. REQUIREMENT FOR RECORDATION: City shall record either a memorandum of this Agreement or this Agreement, including all of the Exhibits, at Owner's/Developer's cost, and submit proof of such recording to Owners/Developers, prior to the third reading ofthe Meridian Zoning Ordinance in connection with the re-zoning ofthe Property by the City Council. lf fbr any reason after such recordation, theCityCouncil fails to adopt the ordinance in connection with the annexation and zoning of the Property contemplated hereby, the City shall execute and record an appropriate instrument of release of this Agreement. 12. REMEDIES: This Agreement shall be enforceable in anycoun ofcompetent jurisdiction by either City or Owner/Developer, or by any successor or successors in title or by the assigns of the parties hereto. Enforcement may be sought by an appropriate action at law or in equity to secure the specific perfbrmance ofthe covenants, agreements, conditions, and obligations contained herein. l2.l In the event ofa material breach ofthis Agreement, the panies agree that City and Owner/Developer shall have thiny (30) days after delivery of notice of said breach to correct the same prior to the non- breaching party's seeking of any remedy provided for herein: provided, however, that in the case ofany such default which cannot with diligence be cured within such thirty (30) day period, if the defaulting party shall commence to cure the same within such thirty (30) day period and thereafter shall prosecute the curing of same with diligence and continuity, then the time allowed to cure such failure may be extended for such period as may be necessary to complete the curing of the same with diligence and continuity. 12.2 In the event the performance of any covenant to be performed hereunder by either Owner/Developer or City is delayed for causes DEVELOPMENT AGREEMENT (RZ 07-022) BRIDGETOWER CROSSING COMMERCIAL PACE 5 OF 9 I l. ZONING: City shall, following recordation of the duly approved Agreement, enact a valid and binding ordinance zoning the Property as specified herein. which are beyond the reasonable control of the pany responsible tbr such performance, which shall include, without limitation, acts of civil disobedience, strikes or similar causes, the time for such performance shall be extended by the amount of time of such delay. 13. SURETY OF PERFORMANCE: The City may also require surety bonds, irrevocable letters of credit, cash deposits, certified check or negotiable bonds, as allowed under Meridian City Code $ I l -5-C, to insure that installation of the improvements, which the Owners/Developers agrees to provide, if required by the City. 15. ABIDE BY ALL CITY ORDINANCES: That Owner/Developer agree to abide by all ordinances of the City of Meridian and the Property shall be subject to de- annexation if the owner or his assigns, heirs, or successors shall not meet the conditions contained in the Findings ofFact and Conclusions ofLaw, this Development Agreement, and the Ordinances of the City of Meridian. 16. NOTICES: Any notice desired by the parties and/or required by this Agreement shall be deemed delivered ifand when personally delivered or three (3) days after deposit in the United States Mail, registered or certified mail, postage prepaid, retum receipt requerted. addressed as follows: OWNER/DEVELOPER: c/o City Engincer City ol Mendian 33 E. CERTIFICATE OF OCCUPANCY: The Owner/Developer agree that no Certificates of Occupancy will be issued until all improvements are completed, unless the City and Developer/Owner has entered into an addendum agreement stating when the improvements will be completed in a phased developed; and in any event, no Certificates of Occupancy shall be issued in any phase in which the improvements have not been installed, completed, and accepted by the City. CITY: DEVELOPMENT AGREEMENT (RZ 07-022) BRIDGETOWER CROSSING COMMERCIAL PAGE 6 OF 9 16. I A party shall have the right to change its address by delivering to the other pany a written notillcation thereof in accordance with the requirements of this section. 17. ATTORNEY FEES: Should any litigation be commenced between the parties hereto conceming this Agreement, the prevailing party shall be entitled, in addition to any other relief as may be granted, to coun costs and reasonable attorney's fees as determined by a Court of competent jurisdiction. This provision shall be deemed to be a separate contract between the parties and shall survive any default, termination or forfeiture of this Agreement. 18. TIME IS OF THE ESSENCE: The parties hereto acknowledge and agree that time is strictly of the essence with respect to each and every term, condition and provision hereof, and that the failure to timely perform any ofthe obligations hereunder shall constitute a breach of and a default under this Agreement by the other pany so failing to perform. 19. BINDING UPON SUCCESSORS: This Agreement shall be binding upon and inure to the benefit of the panies' respective heirs, successors, assigns and personal representatives, including City's corporate authorities and their successors in office. This Agreement shall be binding on the Owner/Developer ofthe Property, each subsequent owner and any other person acquiring an interest in the Propeny. Nothing herein shall in any way prevent sale or alienation of the Property, or portions thereof, except that any sale or alienation shall be subject to the provisions hereof and any successor owner or owners shall be both benefited and bound by the conditions and restrictions herein expressed. City agrees, upon written request of Owner/Developer, to execute appropriate and recordable evidence of termination of this Agreement if City, in its sole and reasonable discretion, had determined that Owner/Developer has fully performed its obligations under this Agreement. 20. INVALID PROVISION: If any provision of this Agreement is held not valid by a court of competent jurisdiction, such provision shall be deemed to be excised from this Agreement and the invalidity thereof shall not af'fect any of the other provisions containcd herein. FINAL AGREEMENT: This Agreement sets forth all promises, inducements, agreements, condition and understandings between Owner/Developer and City relative to the subject matter hereof, and there are no promises, agreements, conditions or understanding, either oral or written, express or implied, between Owner/Developer and City, other than as are stated herein. Except as herein otherwise provided, no subsequent alteration, amendment, change or addition to this Agreement shall be binding upon the panies hereto unless reduced to writing and signed by them or their successors in interest or their assigns, and pursuant, with respect to City, to a duly adopted ordinance or resolution of City. 21 .t No condition governing the uses and/or conditions goveming re-zoning ofthe subject Property herein provided for can be modified or amended without the approval ofthe City Council after the City has conducted public hearing(s) in accordance with the notice provisions provided for a zoning designation and/or amendment in force at the time of the proposed amendment. 22. EFFECTM DATE OF AGREEMENT: This Agreement shall be effective on the date the Meridian City Council shall adopt the amendment to the Meridian Zoning Ordinance in connection with the annexation and zoning ofthe Propeny and execution ofthe Mayor and City Clerk. The applicant is proposing a first amendment to the DA by amending Section 3 "Definitions" modifoing sub-section 3.4 "Property" excluding the Verona Commercial propedies (proposing to concurrently lezone from R-8 to C-G and L-O (see Jile #RZ-07-017) of lhe recorded DA for Verona Subdivision. Staffis recommending that these areas be removed from the curent DA for Verona and instead be subject to the provisions ofa new DA with the language/restrictions provided by Staff below. The existing Verona DA applies to approximately 62 acres located on the east side of N.Ten Mile Road, north of W. McMillan Road and approximately a half a mile south of Chinden Boulevard in Section 26, T. 4N., R.1W. The Verona Commercial site is located on the northeast comer of N. Ten Mile Road and W. McMillan Road and incorporates approximately 19 acres. The site is cunently vacant and the applicant is proposing the site develop with a mix of non residential uses. MI-07-014 - The subject Development Agreement was recorded on November 8, 2001, as Instrument No. 101117652, records of Ada County Idaho. The applicant is proposing a first amendment to the DA by amending Section 3 "Definitions" modifuing sub-section 3.6 "Property" excluding the Bridgetower Crossing Office and Commercial properties Qtroposing to concurrently rezone from C-G and R-4 to C-N and L-O (see Jile #PZ-07-022) of the recorded DA for Bridgetower Crossing Subdivision. The sites are currently vacant land with a mix of residential, commercial and office uses surrounding the proposed projects. UDC 1l-5B-3.D.2 and Idaho Code $ 65-6711,4. provides the City the authority to require a property owner to enter into a Development Agreement (DA) with the City that may require some written commitment for all future uses. The City has sent out notices of the subject request in accordance with the current standards for public hearings (see Section 4, Process Facts, below for publication dates.) There are no required findings for a miscellaneous application/development agreement modification. Below, staff has provided the most pertinent facts and analysis related to the proposed development agreement modifications. At the Planning and Zoning Commission hearing on December 20th, Staff recommended the applicant modify the existing Verona DA to allow more office lots and include the Bridgetower commercial lots as part of the revised Verona DA. Instead, Staff now recommends the applicant modi$ the existing Verona and Bridgetower Crossing Development Agreements to exclude the commercial and office areas and enter into three new Development Agreements to govern the Verona Commercial Project, Bridgetower Crossing OIfice and Bridgetower Crossing Commercial Projects with the language proposed below. With the approval of the AZIPD, the City Council conceptually approved the commercial portion ofthe development and allowed office uses within an R-4 zoning district. The current DA required the applicant to amend the Comprehensive Plan and rezone the office lots prior to issuing a building permit. The commercial lots were also subject to CUP approval as no concept plan was presented to City Council at the time ofthe initial approval. Since that time, the Future Land Use Map has been amended by the City to reflect these approvals. Because the applicant now has a concept plan for the both the Bridgetower Crossing Office and Commercial Projects (attached below) reviewed concurrently with this application and included in Exlibit A, Staff believes the applicant should no longer be subject to the above mentioned CUP requirement. CITY and OWNER/DEVELOPER now desire to amend the Development Agreement in accordance with the terms in this Addendum, which terms have been approved by the Meridian Planning and Zoning Commission and the Meridian City Council in accordance with Idaho Code Section 67-651lA. Owners/Developers of the Property, each subsequent owner and any other person(s) acquiring an interest in the Property. Nothing herein shall in any way prevent sale or alienation of the Property, or portions thereof, except that any sale or alienation shall be subject to the provisions hereon and any successor owner or owners shall be both benefited and bound by the conditions and restrictions herein expressed. City agrees, upon written request of Owner/Developer, to execute appropriate and recordable evidence of termination of this addendum if City, in its sole and reasonable discretion, had determined that Owner/Developer has fully performed its obligations under this Addendum. 4. If any provision of this addendum is held not valid by a court of competent jurisdiction, such provision shall be deemed to be excised from this addendum and the invalidity thereof shall not affect any of the other provisions contained herein. 5. This addendum sets forth all promises, inducements, agreements, condition, and understandings between Owners/Developers and City relative to the subject matter herein, and there are no promises, agreements, conditions or under-standing, either oral or written, express or implied, between Owners/ Developers and City, other than as are stated herein. Except as herein otherwise provided, no subsequent alteration, amendment, change or addition to this second addendum shall be binding upon the parties hereto unless reduced to writing and signed by them or their successors in interest or their assigns, and pursuant, with respect to City, to a duly adopted ordinance or resolution of City. a. Except as herein provided, no condition goveming the uses and/or conditions goveming development of the subject Property herein provided for can be modified or amended within the approval of the City Council after the City has conducted public hearing(s) in accordance with the notice provisions provided for a zoning designation and/or amendment in force at the time of the proposed amendment. 6. I have an e-mail that summarizes a meeting that was held today with Mr. Nary and representatives of the planning department and the clerk's office and what they did is took up the issue of the fees for temporary uses. As you may be aware, it's been sort of controversial as to whether we should be charging for that and particularly as it may pertain to charitable organizations. After this meeting the recommendation to you from this group is that you not charge fees for temporary use permits for the 2008 calendar year. CONSENT TO DE-ANNEXATION AND REVERSAL OF ZONING DESIGNATION: Owner/Developer consent upon default to the reversal ofthe zoning designation ofthe Property subject to and conditioned upon the following conditions precedent to-wit: That the City provide written notice of any failure to comply with this Agreement to Owner/Developer and if the Owner/Developer fails to cure such failure within six (6) months of such notice. 1.1 9 8. INSPECTION: Owner/Developer shall, immediately upon completion of any ponion or the entirety of said development of the Property as required by this agreement or by City ordinance or policy, notify the City Engineer and request the City Engineer's inspections and written approval of such completed improvements or portion thereof in accordance with the terms and conditions of this Development Agreement and all other ordinances of the City that apply to said Development. DEFATII,T: 9.1 In the event Owner/Developer, or Owner's/Developer's heirs, successors, assigns, or subsequent owners of the Property or any other person acquiring an interest in the Property, fail to faithfully comply with all of the terms and conditions included in this Agreement in connection with the Property, this Agreement may be modified or terminated by the City upon compliance with the requirements of the Zoning Ordinance. REQUIREMENT FOR RECORDATION: City shall record either a memorandum of this Agreement or this Agreement, including all of the Exhibits, at Owner's/Developer's cost, and submit proof of such recording to Owners/Developers, prior to the third reading of the Meridian Zoning Ordinance in connection with the re-zoning of the Property by the City Council. If for any reason after such recordation, the City Council fails to adopt the ordinance in connection with the annexation and zoning of the Property contemplated hereby, the City shall execute and record an appropriate instrument of release ofthis Agreement. I l. ZONING: City shall, following recordation of the duly approved Agreement, enact a valid and binding ordinance zoning the Property as specified herein. 12. REMEDIES: This Agreement shall be enforceable in any court of competent jurisdiction by either City or Owner/Developer, or by any successor or successors in title or by the assigns of the parties hereto. Enforcement may be sought by an appropriate action at law or in equity to secure the specific performance of the covenants, agreements, conditions, and obligations contained herein. l2.l In the event ofa material breach ofthis Agreement, the parties agree that City and Owner/Developer shall have thirty (30) days after delivery of notice of said breach to correct the same prior to the non-breaching party's seeking of any remedy provided for herein; provided, however, that in the case of any such default which cannot with diligence be cured within such thirty (30) day period. if the defaulting pany shall commence to cure the same within such thirty (30) day period and thereafter shall prosecute the curing of same with diligence and continuity, then the time allowed to cure such failure may be extended for such period as may be necessary to complete the curing of the same with diligence and continuity. 12-Z In the event the performance of any covenant to be perfbrmed hereunder by either Owner/Developer or City is delayed tbr causes which are beyond the reasonable control of the party responsible for such perfbrmance, which shall include, without limitation, acts of civil disobedience, strikes or similar causes, the time for such performance shall be extended by the amount of time of such delay. 13. CERTIFICATE OF OCCUPANCY: The Owner/Developer agree rhar no Cenificates of Occupancy will be issued until all improvements are completed, unless the Ciry and Developer/Owner has entered into an addendum agreement stating when the improvements will be completed in a phased developed; and in any event, no Certificates ofOccupancy shall be issued in any phase in which the improvements have not been installed, completed, and accepted by the City. 15. ABIDE BY ALL CITY ORDINANCES: That Owner/Developer agree to abide by all ordinances ofthe City of Meridian and the Property shall be subject to de-annexation ifthe owner or his assigns, heirs, or successors shall not meet the conditions contained in the Findings ofFact and Conclusions ofLaw, this Development Agreement, and the Ordinances ofthe City of Meridian. 16. This provision shall be deemed to be a separate contract between the panies and shall survive any default, termination or forfeiture of this Agreement. TIME IS OF THE ESSENCE: The parties hereto acknowledge and agree rhar time is strictly of the essence with respect to each and every term, condition and provision hereof, and that the failure to timely perform any of the obligations hereunder shall constiture a breach of and a default under this Agreement by the other party so failing to pedorm. I 9. BINDING UPON SUCCESSORS: This Agreement shall be binding upon and inure to the beneflt of the parties' respective heirs. successors, assigns and personal representatives, including City's corporate authorities and their successors in office. This Agreement shall be binding on the Owner/Developer ofthe Propeny, each subsequent owner and any other person acquiring an interest in the Propeny. Nothing herein shall in any way prevent sale or alienation of the Property, or portions thereof, except that any sale or alienation shall be subject to the provisions hereof and any successor owner or owners shall be both beneflted and bound by the conditions and restrictions herein expressed. City agrees, upon written request of Owner/Developer, to execute appropriate and recordable evidence of termination of this Agreement if City, in its sole and reasonable discretion, had determined thar Owner/Developer has fully performed its obligations under this Agreement. 20. INVALID PROVISION: If any provision of this Agreement is held not valid by a couft of competent jurisdiction, such provision shall be deemed to be excised from this Agreement and the invalidity thereof shall not affect any ofthe other provisions contained herein. 2l . FINAL AGREEMENT: This Agreement sets forth all promises, inducements, agreements, condition and understandings between Owner/Developer and City relative to the subject matter hereof', and there are no promises, agreements, conditions or understanding, either oral or written, express or implied, between Owner/Developer and City, other than as are stated herein. Except as herein otherwise provided, no subsequent alteration, amendment, change or addition to this Agreement shall be binding upon the parties hereto unless reduced to writing and signed by them or their successors in interest or their assigns, and pursuant, with respect to City, to a duly adopted ordinance or resolution of City. 2l.l No condition governing the uses and./or conditions governing re-zoning of the subject Property herein provided for can be modified or amended without the approval of the City Council after the City has conducted public hearing(s) in accordance with the notice provisions provided for a zoning designation and/or amendment in force at the time of the proposed amendment. 22. EFFECTM DATE OF AGREEMENT: This Agreement shall be efl'ective on the date the Meridian City Council shall adopt the amendment to the Meridian Zoning Ordinance in connection with the annexation and zoning of the Property and execution of the Mayor and City Clerk. The applicant is proposing a first amendment to the DA by amending Section 3 "Definitions" modifuing sub-section 3.4 "Property" excluding the Verona Commercial properlies (proposing to concurrently rezone from R-8 to C-G and L-O (see file #PZ-07-017) of the recorded DA for Verona Subdivision. Staff is recommending that these areas be removed from the cunent DA for Verona and instead be subject to the provisions ofa new DA with the language/restrictions provided by Staff below. The existing Verona DA applies to approximately 62 acres located on the east side of N.Ten Mile Road, north of W. Staff is recommending that these areas be removed fiom the current DA for Bridgetower Crossing and instead be subject to the provisions ofa new DA with the language/restrictions provided by Staffbelow. There are no required findings for a miscellaneous application/development agreement modification. With the approval of the AZiPD, the City Council conceptually approved the commercial portion ofthe development and allowed office uses within an R-4 zoning district. The current DA required the applicant to amend the Comprehensive Plan and rezone the office lots prior to issuing a building permit. The commercial lots were also subject to CUP approval as no concept plan was presented to Cif Council at the time ofthe initial approval. Since that time, the Future Land Use Map has been amended by the City to reflect these approvals. Because the applicant now has a concept plan for the both the Bridgetower Crossing Office and Commercial Piojects (attached below) reviewed concurrently with this application and included in Exhibit A, Staff believes the applicant should no longer be subject to the above mentioned CUP requirement. Legal Department - Bill Nary De Weerd: ltem 7 under Department Reports, I would ask Mr. Baird to, please, give an update on the temporary sales ordinance. Baird: Thank you, Madam Mayor, Members of the Council. I have an e-mail that summarizes a meeting that was held today with Mr. Nary and representatives of the planning department and the clerk's office and what they did is took up the issue of the fees for temporary uses. As you may be aware, it's been sort of controversial as to whether we should be charging for that and particularly as it may pertain to charitable organizations. After this meeting the recommendation to you from this group is that you not charge fees for temporary use permits for the 2008 calendar year. The city is more o.
