Broadway Ave. Suite 300 Meridian, Idaho 83642 RE: AZH-2020-0987, Spurwing Sewer Annexation Dear Mr. Mayor and Members of the Council; Enough is enough! It is time the City of Meridian stop allowing itself to be manipulated by developers and in this case specifically by Mr. Hewitt! In spite of the recent agreement between Mr. and Mrs. Tseng and Mr. Hewitt,this offer of annexation and request for approval of an emergency access route must be rejected for the following reasons. 1. Mr. Hewitt illegally commenced construction on this road over a holiday weekend without benefit of a permit by Ada County. Through his planner, he had the temerity to state to the Ada County Commissioners,that they did not know they needed a permit to build on Ada County property. 2. Ada County found in a permit hearing and subsequent appeal that the proposed route was in appropriate due to the negative impact on the entire neighborhood, not the Tseng's property alone. Nothing has changed! 3. The proposed route is not the most efficient route available as it utilizes over half of the normal route to the Olive Tree Subdivision, the same portion where the potential for obstruction requiring an emergency access, is most likely to occur. 4. Alternative methods to provide protection DO exist, and meet the requirements of the Fire Marshall. 5. The Fire Marshall's attempt in the December 151" Council meeting, to expand the potential use of the emergency access to Police and Paramedics was soundly renounced by the Meridian Police Chief, when he pointed out that use by Police and Paramedics requires a second type of lock box. Only the Fire Department can access the Knox Box system. The Police Chief further stated that in his entire career he has never seen an emergency access like the one proposed by Mr. Hewitt used by Police or Paramedics. 5. Mr. Hewitt's offer of the subject 6/10ths of an acre for annexation, so as to "allow"the City and Suez water to have access to their respective systems is nothing more than a sham. Mr. Hewitt is already under an Ada County court order to restore the property to its pre-July 2019 state, which includes the existing access, which met the need of both the City and Suez. His altruistic offer is nothing more than a ploy to avoid that Court mandate. 6. Neither the City nor Suez Water need to act to meet its requirement for maintenance access. By denying this request Mr. Hewitt remains under Court order to restore access for both. Finally, even with the accommodation by the Tseng's and the sale of their property,this proposed emergency access route remains detrimental to the neighborhood and is the absolute wrong method to provide the required fire protection. This entire long process is nothing more than Mr. Hewitt attempting to manipulate the Planning and Zoning Commissions of both the County and the City into allowing him to have his way. Please do not validate his 2019 malfeasance and allow the City to be manipulated by Mr. Hewitt into approving this request.
