PZ - Community Development Memo - Easement Mayor Robert E Sirnison City Council Members: E IDIAN Treg Bernt Brad Hoaglun C� I Joe Borton Jessica Perreault D AHO Luke Cavener Liz Strader V December 21, 2020 MEMORANDUM TO: P&Z Commission Chair and Commissioners CC: Bruce Freckleton, Joseph Dodson, Warren Stewart, David Bailey, Kevin Craig FROM: Amanda McNutt, Land Development Supervisor RE: Mile High Pines The Civil Engineer for the Mile High Pines project has submitted conceptual drawings to me for review which appear to meet Public Works standards, including all permanent structures being outside of the footprint of the City easement(s). The City easement language states that the "Grantor will not place or allow to be placed any permanent structures, trees, brush, or perennial shrubs or flowers within the area described for [the] easement". This has been the standard language for many years. Unfortunately, there have been occasions where encroachments on the City easement have not come up as a point of discussion in the preliminary design for projects, and this has caused issues later on in the review and approval of those projects. To that end, Land Development and Public Works were addressing the easement encroachment issue with this project early so as to avoid problems further along in the design process. Similarly, I had asked for more information on service line design from the project engineer to ensure they had a plan in place that would fall within our standards. The project engineer has demonstrated to me that they have a plan in place to accommodate the Public Works easements and appropriate service line design.
