This DECLARATION OF EASEMENTS VLOCATING PRE-EXISTING
EASEMENTS (this "Declaration") is made this A day of , 2019,
by and between Corey Barton Homes, Inc., an Idaho corporation, dba CBH Homes whose
address is 1977 E. Overland Road, Meridian Idaho 83642 ( "CBH" ); Endurance Holdings LLC,
an Idaho limited liability company whose address is 1977 E. Overland Road, Meridian, Idaho
83642 ( "Endurance" ) and Southridge Farm LLC, whose address is 401 W. Front Street, Suite
401, Boise Idaho 83702 ("Southridge") (CBH, Endurance, and Southridge are collectively
known as "Grantor") in favor of Joseph R. Rice and Stacie M. Rice, husband and wife whose
address is 2212 N. Old Thorn Lane, Meridian ID 83642 ("Rice").
RECITALS
A. Rice is the owner of that certain parcel of real property located in Ada County,
Idaho, which is more particularly described and depicted on Exhibit A and is generally depicted
on Schedule I ("Rice Parcel").
B. CBH is the owner of that certain parcel of real property located in Ada County,
Idaho, which is more particularly described on Exhibit B and generally depicted on Schedule I
("CBH Parcel"). Endurance is the owner of that certain parcel of real property located in Ada
County, Idaho, which is more particularly described on Exhibit B and is generally depicted on
Schedule I ("Endurance Parcel"), Southridge is the owner of that certain parcel of real property
located in Ada County, Idaho, which is more particularly described on Exhibit B and is generally
depicted on Schedule I ("Southridge Parcel').
C. The Rice Parcel was previously a portion of a larger parcel ("Prior Rice Parcel')
that was benefitted by certain easements over portions of the CBH Parcel, the Challenger Parcel,
the Endurance Parcel and/or the Southridge Parcel including but not limited to those more
particularly described on Exhibit C ("Pre-Existing Easements").
D. When the balance of the Prior Rice Parcel was sold off by Rice, the Rice Parcel
no longer bordered the Pre-Existing Easements and no easement exists providing access to the
Rice Parcel.

E. As an accommodation, CBH and Endurance have permitted Rice access to the
Rice Parcel over Endurance Parcel and the CBH Parcel pursuant to a revocable license over an
unpaved drive lane (the "Rice Access").
F. Pursuant to Idaho Code Section 55-313, Grantor has elected to a relocation of the
access provided by the Pre-Existing Easement to the Rice Access
DECLARATION
NOW, THEREFORE, in consideration of the above recitals, CBH and Endurance
pursuant to Idaho Code Section 55-313, does hereby grant unto Grantee, and its successors and
assigns, an ingress-egress easement over the property the area where the present Rice Access is
located. The foregoing grant is subject to the right of Grantor to further relocate the easement
established herein pursuant to Idaho Code Section 55-313. The Pre-Existing Easements shall be
of no further force or effect.
