Dear Alan,
This letter provides Cushing Terrell’s response to the second round staff comments below. All supporting
documentation is attached along with this response letter.
Thank you for submitting an application for a Certification of Zoning Compliance (CZC) to construct a
207,000 square foot warehouse. The following are staff’s comments on your submittal:
1. The first goes back to what I brought up with the first response:
a. UDC 11-3A-19 “Structure and Site Design Standards” state for properties greater than two (2) acres in
size, no more than fifty percent (50%) of the total off street parking area for the site shall be located
between building facades and abutting streets. This requirement is not met.
Your response was “as the building is being designed to have multiple tenants in the future we feel that
the entrances to the “front” of the buildings should have the parking located closest to them. Along with
Joe Bongiorno requiring a drive aisle of 26’ around the entire building. This parking design fits the
requirements of future tenants to safely access the front of the building while not walking around the
entire building and meets the requirements for Fire apparatus access.”
That said, you would either need to meet the requirements, or request Alternative Compliance. Per the
UDC:
C. Alternative Compliance: If: 1) the location of existing buildings or structures prevents conformance
with the standards of this section, or 2) strict adherence to such standards would create inconsistency in
the design objectives of the proposed development, the Director may consider an alternative design
proposal through the alternative compliance provisions as set forth in section 11-5B-5 of this title. The
Director may approve, or recommend approval of, such an alternative compliance proposal when the
overall design, as proposed by the applicant, meets or exceeds the intent and the requirements of this
section and is not detrimental to public health, safety, and welfare. (Ord. 16-1717, 1-3-2017).
I recommend you get more than 50% of the parking spaces at the north side of the building, otherwise I
would need a request for alternative compliance and something from you that describes why the parking
orientation as proposed meets or exceeds the intent of the requirements.
i. See attached Alternate Compliance request per the UDC.
2. Has the ditch along the western portion of the property been tiled? If not it must be tiled or
incorporated into the landscaping as an amenity (such as along the pathway).
a. The ditch along the western portion of the property is an existing tiled ditch.

3. How is external mechanical equipment being screened?
a. There is not mechanical roof top equipment to be screened in core and shell. We have attached a
roof plan to show there is no roof top equipment. If future build outs require roof top units, we
will submit approved screening or line of sight drawings at time of build out.
4. the 5-foot walkway extended to the front of the building must use pavers or scored concrete and not
striping. This is per UDC 11-3A-19B.4.
a. Attached C100 CZC Site plan shows updated walkway to be scored concrete in place of striping
per UDC 11-3A-19B.4.
