CC - Applicant's Response to Staff Report 11-24 PLANNING SERVICES P.O.Box 405 Boise,ID 83701 20&9M 1609 MEMORANDUM TO: Mayor Simison, Meridian City Council Joseph Dodson, Associate Planner FROM: Penelope Constantikes DATE: November 22, 2020 RE: H-2020-0060 HORSE MEADOWS SUBDIVISION—PRELIMINARY PLAT CITY COUNCIL HEARING—NOVEMBER 24,2020 The applicant and project team are in receipt of the staff report for the November 24,2020, City Council Hearing. In order to meet the complexity of the site and requirements of the City of Meridian and Ada County Highway District,the plat has evolved in an iterative process. The applicant and project team believe that the plat before you meets all standards and requirements of the Meridian Planning Division,the Meridian Fire Department, and the Ada County Highway District as well as the recommendation of the Meridian Planning& Zoning Commission. • Open space for the residents has been relocated to the center of the project as recommended by the P&Z Commission and will include children'&play equipment as previously proposed though not indicated on the plat at this time. • Additional open space will be located at the southwest corner while also providing sewer and water extension easement area. • The number of building lots along Black Cat Road have been reduced in number from 8 to 7 and lots have been widened as recommended by the P&Z Commission. The average lot size has been increased from 4,149 to 4,602 s.f., or an increase of 453.5 s.f. • Open space provided with the subdivision based on the UDC standards is 24%over the minimum of 10% for a total qualified open space of 25,363.5 s.f of open space. See attached. • City staff and District staff indicated a more permanent treatment of the easement area along the south portion of the site would be preferable. This is proposed with the public road on the site being extended through the easement area to the east property line and the removal of easement access to Black Cat Road occurring when the public road is constructed and accepted by ACHD as a part of the Final Plat recording. • The applicant recognizes the necessity of the release of easement rights across the site as a part of the construction and use of the new public road. The applicant and project team are actively working with a land use/development attorney to prepare a modification of the existing easement to exclude the easement rights encumbering the site while retaining the remainder of the easement for access of the three adjacent property owners to access the new public road. • Conceptual elevations submitted with the application are to scale and show the required minimum side yard setbacks. See attached. LAND USE PLANNING - DUE DILIGENCE • INDIVIDUAL ASSESSMENTS The applicant and project team offer the follow responses to the Conditions of Approval outlined in the staff report. PLANNING DIVISION • The Development Agreement is understood. Direct lot access to Black Cat Road and Pine Avenue will be prohibited. Easement rights of the applicant will be terminated. • The previous Lot 10 is now shown as a future public road. • Prior to submittal of the final plat application an updated landscape plan will be submitted and will reflect the approved preliminary plat. • Four(4) feet of separation will be provided between the new ACHD ROW and the detached sidewalk—also to be incorporated into the landscape plan. • Plat Note 18 will revised as indicated. • The landscape plan will be revised to include the required plant materials,updated calculations as needed, children's play equipment, and sidewalk as indicated with 4 foot separation. • Fencing in compliance with the UDC will be constructed. PUBLIC WORKS • Street light locations are depicted on the preliminary plat. All required street light materials will be submitted with the final plat application. • Storm drain facilities will be located as prescribed by the City of Meridian. • The water main stub in the northwest corner of the site will be abandoned as specified on the preliminary plat. • The Geotech Report and updated water monitoring data was submitted to the City of Meridian on October 12, 2020.
