LIMITATIONS OF LIABILITY (a) The Company's liability under Commitment Condition 4 is limited to the Proposed Insured's actual expense incurred in the interval between the Company's delivery to the Proposed Insured of the Commitment and the delivery of the amended Commitment,resulting from the Proposed Insured's good faith reliance to: (i) comply with the Schedule B, Part I—Requirements; (ii) eliminate,with the Company's written consent, any Schedule B, Part II—Exceptions;or (iii) acquire the Title or create the Mortgage covered by this Commitment. (b) The Company shall not be liable under Commitment Condition 5(a) if the Proposed Insured requested the amendment or had Knowledge of the matter and did not notify the Company about it in writing. (e) The Company shall not be liable for the content of the Transaction Identification Data, if any. AREA OF APPLICATION . Fully-Protected Residential Area: The residential area covenants in Part B in their Entirety and shall apply. to the Subdivision heretofore mentioned. II PART B, RESIDENTIAL AREA COVENANTS . (l) Land Use � Building' Type. No lot shall be used except for residential and agricultural purposes. No building shall be erected, altered, placed., or permitted to remain on any lot other than one detached single-family dwelling not to exceed l- 1.10 ()ti:3;�' two stories in height and a private garage or carport for not more than two. cars and one detached outbuilding for housing livestock. All construction to be of new materials, except that used brick may be used, (2) Dwelling Cost, Quality and Size: No dwelling shall be permitted on any lot at a cost of less than $25,000.00. It being the intention and purpose of the covenant to assure that all dwellings shall be of a quality of workmanship and materials substantially the same or better than that which can be produced.on the date these covenants are recorded at the minimum cost stated herein for the minimum permitted dwelling size. The ground floor area of stated herein main structure, exclusive of one-story open porches and garages, shall be not less than 1000 square feet for a one-story dwelling, nor less than 850 square feet per level for a dwelling of more than one story. (4) Lot Area and Width: No dwelling shall be erected or placed on any lot having a width of less than 100 feet at the minimum building set back line nor shall any dwelling be erected or placed on any lot having an area of less than 43,560 square feet, except that a dwelling may be erected or placed on all corner and cul-de-sac lots as shown on the recorded plat. (5) Easements: Easements for installation and maintenance of utilities, irrigation and drainage facilities are reserved as shown on the recorded plat. Within these easements, no structure, planting or other material shall be placed or permitted to remain which may damage or interfere with the installation and maintenance of utilities or that which may change the direction of flow of drainage or irrigation channels in the easements or that which may obstruct or retard the flow of drainage or irrigation channels in the easements or easement area of each lot and all improvements in it shall be maintained continuously by the owner of the lot, except for those improvements for which a public authority or utility company is responsible. (6) Nuisances: No noxious or offensive activity shall be carried on upon any lot nor shall anything be done thereon which may be or may become an annoyance or nuisance to the neighborhood. No automobiles, trailers, boats or other vehicles are to be stored on streets or front and side lots unless they are in running condition, properly licensed and are regularly used. 3- JL40 (7) 'Temporary Structures: No structure of a temporary character, trailer, basement tent, shack, garage, barn or other outbuilding shall be used on any lot at any time as a residence either temporarily or permanently. (8) Signs: No sign of any kind shall be displayed to the public view on any lot except one professional sign of not more than one square foot; one sign of not more than five square feet of advertising the property for sale or rent; or signs used by a builder to advertise the . property during the construction and sales period. (9) Oil and Mining Operations: No oil drilling, oil development operations, oil refining, quarrying or mining operations of any kind shall be permitted upon or in any lot, nor shall oil wells, tanks, tunnels, mineral excavations or shafts be permitted upon or in any lot. No derrick or other structures designed for use in boring for oil or natural gas shall be erected, maintained or permitted upon any lot. (10) Individual water supply systems shall be permitted on any lot provided such system is located, constructed, and equipped in accordance with the requirements, standards, and recommendations of the State public health authority. Approval of such system as installed shall be obtained from such authority. (11) Garbage and Refuse Disposal: No lot shall be used or maintained as a dumping ground for rubbish. Trash, garbage or other waste shall not be kept, except in sanitary containers. Each lot and its abutting street are to be kept free of trash, weeds and other refuse by the lot owner. No unsightly materials or other objects are to be stored on any lot in view of the general public. (12) Until such time as a sanitary sewer system shall have been constructed to serve this subdivision, the individual sewage disposal system on each lot shall be constructed to the requirements of the "Standard for Subsurface Sewage Systems" as published by the Idaho Department of Health, with a specific minimum requirement of 85 square feet of modified field drain trench bottom area per bedroom in clean sand--gravel strata, drain lines will be no deeper than 18" below the surface and also shall be so located on each lot that there is adequate space allowed for an additional system in case.of failure of the original installation. The design of each individual system shall be submitted to and approved by the proper health authorities, currently the City-County Health Department, for each lot prior to commencing any on-site construction. PART D. GENERAL PROVISIONS (1) Term: These covenants are to run with the land and shall be binding on all parties and all persons claiming under them for a period of forty years from the date these covenants are recorded; after which time said covenants shall be automatically extended for successive periods of 10 years unless an instrument signed by a majority.of the then owners of the lots has been recorded agreeing to change said covenants in whole or in part. (2) Enforcement: Enforcement shall be by proceedings at law or in equity against any person or persons violating or attempting to 5- violate any covenant either to restrain violation or to recover damages.
