Grantor is the owner of that certain real property located in Ada County, Idaho, and more particularly described in Exhibit 1, attached hereto and incorporated herein by this reference ("Grantor's Property"). Grantor's Property connects to a collector road identified in Exhibit 1 as "W.Plaza Shops Drive." 2. Grantees are the "Owners", as identified in that certain Cross Access Easement Agreement, recorded November 14, 2018, as Instrument No. 2018-108834, Official Records of Ada County, Idaho (the "Access Agreement"), who are the respective owners of those certain parcels of real property located in Ada County, Idaho, and more particularly described in Exhibits A, B, C & D, attached hereto and incorporated herein by this reference ("Grantees' Properties"). 3. The Access Agreement, among other things, contemplates the granting for the benefit of Grantees' Properties an access easement on, over and across Grantor's Property for "pedestrian and vehicular ingress and egress to one or more public access points located on Linder Road and/or Chinden Boulevard." 4. Grantor and the City of Meridian entered into that certain Development Agreement, recorded on April 10, 2019, as Instrument No. 2019-028376, Official Records of Ada County, Idaho (the "Development Agreement"). Section 1.2.4 of Exhibit B (Agency & Department Comments), at page 59 of the Development Agreement, sets forth the requirement that Grantor similarly provide a"cross access/ingress-egress"for the Grantees' Properties. 5. It is the intent of Grantor that the easement herein granted fulfills that which•is contemplated by the Access Agreement and that which is required by Section 1.2.4 of the Development Agreement by connecting Grantees' Properties to W. Plaza Shops Drive, thereby 1 111--- 11--A0 n providing Grantees' Properties with pedestrian and vehicular ingress and egress to and from Linder Road and Chinden Boulevard. 6. The easement herein granted shall be appurtenant to and for the benefit ,of Grantees' Property and shall run with the land. 7. The easement herein granted herein shall inure to the benefit of and be binding upon the parties identified herein, their heirs, personal representatives, successors and assigns, and upon any person acquiring any of the real property described herein, or any portion thereof, or any interest therein, whether by operation of law or otherwise.
