Broadway Ave. Meridian, ID 83642 RE: 2810 E Franklin Road Annexation Application Parking,Cross-access and Ditch Waiver Requests Dear Ms.Allen: Per your comments and City Code requirements,we have revised the proposed site plan forthe 2810 E Franklin Road annexation project. Our changes include relocating the proposed ADA space out of the required 35' landscape buffer as depicted on the updated site plan.Due to site constraints,other changes as requested have not been completed,further explanation is provided below. We are requesting to waive or vary from three requirements as existing site constraints make compliance difficult. The property owner plans to utilize and expand upon the existing building on site for the proposed project, the remainder of the site has been designed to accommodate the existing and proposed building footprint.The topography of the site combined with space available for development has presented challenges in meeting the parking requirements for a commercial zone(UDC 11-3C-6B-1)and construction of cross-access driveways to the east and west.Given these circumstances,we request to waive the requirement to construct cross-access driveways and request to provide 13 parking spaces rather than the required 16 parking spaces. We have created an exhibit to demonstrate the grade and site constraints present on the site.The west side has +/-5'of grade difference,which would mean we'd need to grade the slope to ensure the connection would work for the property to the west and for the subject site,the east side has about 2'of grading that would be required. We are concerned that the expense and design required to construct these connections may not serve the subject or adjacent sites well.Adjacent sites are currently being used for commercial purposes;the east property is annexed into the City;the west property is in the County. Additionally, construction of the driveway would eliminate parking stalls on the east part of the site,which would present an additional hurdle in complying with parking requirements. The property owner is agreeable to providing a cross-access agreement to both properties to facilitate a flexible means for future construction of a shared driveway, should the adjacent properties redevelop,as is required by UDC 11-3A-3A-2. The Snider Lateral exists at the north part of the site.As there is an easement surrounding the lateral and the edge of our proposed parking lot will be contained with a retaining wall,we propose to leave the lateral open. We believe thatthe retaining wall along with the proposed perimeterfence will secure the parking lot and public from the lateral while maintaining a natural feature of the site.As such,we request that the Council allow the lateral to remain open. 9233 West State street • Boise, Idaho 83714 • 208.639.6939 • kmenglip.com As discussed, the existing building together with the lateral at the north and slope of the site have created a unique set of site constraints that make meeting the parking requirements and cross-access construction difficult.
