Bower Street is currently improved with vertical curb and gutter, but no sidewalk abutting the site. Due to the fact that the street is not a through street, District staff is not requiring the construction of sidewalk on Bower Street. • Meridian Road: o The site has frontage on Meridian Road. Meridian Road is currently improved with vertical, curb, gutter, and sidewalk abutting the site. o The site has access to Meridian Road via a driveway located at the north property line. Meridian Road is a minor arterial roadway, and the District typically restricts access to arterials based on the posted speed limit. This driveway is the only access into the existing building on the site (building previously utilized by Ada County Weed Control). In addition, the portion of Meridian Road abutting the site is included in the Split Corridor roadway project (see comments below). At this time, District staff is not restricting this driveway, but the driveway may be restricted in the future with the construction of the Split Corridor roadway project. • Split Corridor Roadway Project and Right-of-Way: Meridian Road abutting the site is included in Phase 2 of the Split Corridor project (Franklin Road north to Fairview/Cherry Lane). This project is listed in the update to the Five Year Work Program (scheduled to be adopted January 18, 2006) as preliminary development (construction year not yet established). The concept plan for the Split Corridor project shows the cross-over portion between Main and Meridian Road coming back together adjacent to the east of this site (see attached concept). Because the roadway project has not yet been designed, the right-of- way width has not yet been determined. Therefore, District staff is not requiring any right-of- way dedication at this time. There is 60-feet of existing right-of-way for Meridian Road abutting this site. • No site improvements are required by ACHD, but the applicant will be required to pay a traffic impact fee. The applicant will need to submit architectural plans to ACRD for review by the Development Review Division for purposes of impact fee calculation. (Ada County Weed control property) Mr. Bruneel, In response to your inquiry, I have determined the following The City of Meridian has adopted a new zoning code which is effective as of September 15, 2005. From the information you have provided, it appears your business would be classified as a Major Vehicle Repair Shop. The City classifies vehicle repair in two categories: minor and major. The use of the property to sell tires qualifies as a minor vehicle repair shop, but the rebuilding of engines is classified as major vehicle repair. MCC 11-1A-1 defines Minor Vehicle Repair as: "The use of a site for minor vehicle maintenance and repair. The use includes vehicle repair garages, muffler shops, fire sales and installations, transmission shops, and wheel and brake shops." MCC-1A-1 also defines Major Vehicle Repair as: "The use of a site for major vehicle rebuilding or reconditioning. The use includes engine rebuilding; major reconditioning of worn or damaged motor vehicles; and collision service, including body, frame, or fender straightening or repair. The property you have inquired about, 517 North Meridian Road, is zoned I-L (Light Industrial). Per the table of Allowed Uses contained in MCC 11-2C-2, both Major and Minor Vehicle Repair shops are principal permitted uses in the I-L zone, meaning that they are allowed uses. They are subject to Specific Use Standards contained in MCC-11-4-3.38 which state: "A. Where adjoining a residential property or district, all repair activities (including, but not limited to, open pits and lifts) shall occur within an enclosed structure. B. Inoperable or dismantled motor vehicles shall be stored behind a closed vision fence, wall, or screen or within an enclosed structure and shall not be visible from the street."
