BY THE CITY COUNCIL: BIRD, DONNELL, ROUNTREE, WARDLE
AN ORDINANCE ENACTING A NEW TITLE 7, CHAPTER 1, SECTION 12,
MERIDIAN CITY CODE MAKING IT UNLAWFUL TO DRIVE IN A
NEGLIGENT MANNER; AND PROVIDING FOR A WAIVER OF THE
READING RULES AND PROVIDING AN EFFECTIVE DATE.
BE IT ORDAINED BY THE MAYOR AND CITY COUNCIL OF THE
CITY OF MERIDIAN, IDAHO:
Section 1: That Title 7, Chapter 1, Section 12, Meridian City Code is hereby
enacted to read as follows:
7-1-12 NEGLIGENT DRIVING
It shall be unlawful for any person to operate a motor vehicle in a negligent manner over
and along the highways. streets or alleys of this City. For the purpose of this Section. to
"operate in a negli~ent manner" shall be construed to mean the operation of a motor
vehicle in the following manner:
A. The engaging in any motor vehicle speed contest or exhibition of speed: and/or
B. Excessive. unreasonable. rapid acceleration of a motor vehicle: and/or
C. The operation of a motor vehicle where the operator has less than full control of the
~ and direction of movement of the vehicle. The collision by a vehicle with any
stationary object shall be prima facie evidence of a violation of this Section.
Section 2: That pursuant to the affirmative vote of one-half (1/2) plus one (1) of
the Members of the full Council, the rule requiring two (2) separate readings by title and
one (1) reading in full be, and the same is hereby, dispensed with, and accordingly, this
Ordinance shall be in full force and effect upon its passage, approval and publication.
