Dr. Mr. Johnson,
Staff has completed review of your proposed Certificate of Zoning Compliance (CZC) for the Gem Innovation School
located at 5390 N. McDermott Rd. In order to complete the CZC, the following must be addressed:

1. UDC 11‐3A‐11 limits light spill to .1 foot‐candles when abutting residential. The foot candle limit is exceeded along
the northeast, east, and south property line.
a. Also, please provide “cut sheets” or details indicating the style of light fixtures and reflecting that they are
fully downcast and shielded.
2. The fencing around the playfield is shown as vinyl‐coated chain link on the site plan whereas the landscape plan
indicates it is opaque vinyl. Will revise to vinyl coated chain link
3. The tree removal and preservation plan on Page 1 of the landscape plan indicates 506 caliper inches being removed,
with Page Two reflecting 146 inches needing mitigation and 76” provided. Staff has forwarded this to the City
Arborist and is awaiting whether this mitigation is acceptable or if additional trees or widths are necessary. Brian has
coordinated with the City Arborist on the tree planting count but we’ve not been successful and getting the process
of the tree trust.
4. Why is Gem Prep St. shown as incomplete on the landscape plan? In working with ACHD, they don’t want pavement
extended to the north boundary as it won’t get driven on . Instead, the school will pay into a road trust so that
when it is needed it will have those funds available. In the interim, the landscape plans are seeding to stabilize the
dirt.
5. Please show contours depicting the berms along N. McDermott Rd on the landscape plan. LA will add to plans.
6. The Architectural Standards Manual (ASM) states “Untextured concrete panels and prefabricated steel panels are
prohibited as field materials for building façades, except when used with a minimum of two other qualifying field
materials and meeting all other standard fenestration and material requirements.” (5.1I). It appears this is exceeded
on the all elevations except the west and it does not appear there are two other field materials other than lap siding.
The applicant will either need to reduce the metal panels to less than 20% of each façade or submit a request for a
design exception as is described in Page A‐4 of the ASM.
7. Please provide information describing how ground mounted or rooftop mounted mechanical equipment will be
screened. The site plan notes masonry dumpster enclosures are on the architectural plans, whereas it is not.
8. Please be advised public access easements will be required for all pathways crossing the property. We are
submitting the pedestrian easement along McDermott to ACHD this week. The easement for the pathway along the
southern boundary will be submitted separately to the City.

Hello Dawn,
Thank you for the exhibit, yes that would be acceptable. Yes the ROW would be need to be dedicated by warranty deed
and yes the dollars would be refunded after 10 years similar to the future school flashers. I would generate a road trust
calculation once everyone is on board. I can send over what the cost would look like. I will verify with my supervisor just
to confirm.

I think Option 1 is really the best way to go for all parties. I’m attaching an exhibit of where we’d cut off, the PC of the
curb return. With that, I have a few follow up things.
I’m assuming we’d dedicate the right of way on our property only.
What would be the amount that would be placed in the road trust?
Would these dollars be refunded after 10 years similar to the future school flashers? (I have to believe the road
would get built but want to be sure.)

Good Morning Dawn,
After further discussion within the office you will have two options.
Option 1: Stop Gem Street just past the driveway and sidewalk into the school and road trust for the rest of the road.
Then it gets extended past the driveway to the school when there is connectivity, we don’t create an unused segment of
roadway (or a segment used for something other than intended) and the length of Gem Street is much closer to the 150’
with a viable turnaround and visible end of road sign from McDermott. If fire is ok with it we think that might be the best
solution. Essentially this option would eliminate the need for a turnaround as we are closer to the 150’ distance
requirement. This road trust would be separate from the flashers and would only extend to boundary line.
Option 2: Construct turnaround at the end of Gem Street
Here are the answers to the couple other question you had:

The speed limit sign will need to be installed due to the change in speed from McDermott even though we have a short
distance.
Your question about the requirement of flashers with other development in the area. So the reason the flashers is a
requirement for only Gem School is simply because you are constructing the school itself. So the installation of the
flashers are required anytime we have a school development. ACHD has determined that due to the current
development in the area that the need for the flashers now is not warranted therefore a road trust is being asked for.
