Broadway Ave Meridian, ID 83642 RE: Applicant’s Response to Revised Staff Report Gateway at Ten Mile (H-2020-0046) Dear Commissioners and City Staff: On behalf of the Applicant, GFI- Meridian Investments III, LLC, we provide this response to the Revised Staff Report. We appreciate planning staff’s continued work on and support of the project. We agree to the new proposed conditions, except that we request Condition VIII.A.1.b be revised as follows: b. The Applicant is required to submit a Development Agreement Modification once a more specific development plan is known or when any future subdivision occurs; the future development plan shall address internal vehicle and pedestrian circulation, streetscapes, future uses, building design, and access if any future development or application materially deviates from the approved Development Plan and recorded Development Agreement. The City shall not issue a building permit until the property is subdivided and a specific development plan is approved by Council. Up to two (2) building permits may be obtained prior to recordation of the plat. Through collaboration with City staff, we believe we have now presented a development plan that provides a clear guideline for future development, especially when coupled with the other conditions imposed in the Development Agreement and in light of the permits we still require (conditional use permit and subdivision). Please see attached development plan with street sections, bike and pedestrian circulation, and plaza features. If we need to change the approved Development Plan (for example, based on the needs of an end user, or if ACHD’s approval of access points materially alters the internal circulation), then we would need to obtain a Development Agreement Modification as to the changed aspects before we could proceed. We also request the ability to obtain up to two (2) building permits in the commercial area prior to recording a final plat. The buildings would allow us to move quickly if the right commercial users come along and would provide a catalyst for starting the commercial area. The City has allowed other uses to obtain multiple building permits prior to final plat, including in the Ten Mile Specific Plan Area. Thank you for your consideration of these comments.
