Thank you again for your time meeting this week to discuss the open space for Chukar Ridge Subdivision.I have reviewed the proposal of
adding the pedestrian pathway to the east with the development team and they are in favor of this approach.This will result in us having the
required minimum of 10%open space as all of the spaces shown on the open space exhibit are counted resulting in 10.2%open space.In
addition to this 10.2%open space we have all of the un-counted irrigation drain lateral area which,although not counted as open space by
code,does in fact have many positive benefits of open space for the community.Below is a detailed explanation of our approach to the open
space.I am planning on having some formal exhibits to you next week that can be utilized in the staff report preparation and at the June 4
Hearing.With the newly developed pathway amenities package and the future elementary school directly adjacent to the community we
would suggest that we focus our investment into the pathway features and not include a tot lot that would simply duplicate what is available
at the school.
All pathways are shown in the pathway plan and all various material types are depicted:
• Pink:Gravel
• Blue:Asphalt
• Green:Concrete Sidewalk
• Orange:Asphalt or Gravel

Thank you for the question. As I read the code it indicates that the purpose is to limit tiling of natural
waterways. We plan to leave it as open ditch and will comply with 11-3A-6 A. It goes on to say that
11when piping is proposed" B. shall apply. We are not proposing to pipe this drain.
So it seems to me that leaving it open and then complying with the requirements of the irrigation
district (no planting or irrigation allowed) is compliant with the code.
If we are being asked to define how the ditch is an amenity I can provide you with some more
information.

Per our Code:
11-3A-6: DITCHES, LATERALS, CANALS OR DRAINAGE COURSES:
A. Purpose:The purpose of this section is to limit the tiling and piping of natural waterways,
ditches, canals, laterals, sloughs and drains where public safety is not a concern as well as improve,
protect and incorporate creek corridors (Five Mile, Eight Mile, Nine Mile, Ten Mile, South Slough and
Jackson and Evan Drains) as an amenity in all residential, commercial and industrial designs. When
piping and fencing is proposed,the following standards shall apply.
B. Piping:
1. Natural waterways intersecting, crossing, or lying within the area being developed shall
remain as a natural amenity and shall not be piped or otherwise covered. See also subsection C1 of
this section.
2. Irrigation ditches, laterals, canals, sloughs and drains may be left open when used as a water
amenity or linear open space, as defined in section 11-1A-1 of this title. See also subsection C2 of
this section.
It appears you are proposing to keep the McFadden Drain open. How do you meet the above,
otherwise you need to tile it or request a waiver with a detailed reason.
