While I agree with other commenting neighbors that a 55+ community would be preferable and more consistent with this area than the 195-unit designated “for rent” development proposed, I recognize this is a preference we may not see realized. If the proposed development should be approved in some form I have three concerns that would fall in the category of “adverse impacts on other property in the vicinity” according to Title 11 of the UDC, 11-5B-6 Conditional Uses, E. Findings, item 4. First is the lack of open play space for children. The proposed dog park might make sense in a 55+ retirement community where there may be more pets than children, but in the proposed development there is an obvious need for a substantial outdoor playground area to support the needs of kids and families within the neighborhood. To neglect this need might be expected to create added demand and pressure upon the play area within Spurwing Heights. A further concern with a dog park is that with its proposed location directly across the street from us instead of internal to the development, if not well maintained this is a potential source of resultant odors located directly across from our property and others’. A large playground with an appropriate array of quality heavy-duty play equipment and other features would serve both concerns and improve the design and usability of the development. Second, rental properties without attached garages are more likely to generate parking overflow that cannot be handled on-site. Any parking overflow would fall onto W Tree Crest Drive, which would have an adverse impact on the existing community to the north. Third, credible reports gathered from other members of our community consulting several real estate professionals indicate that the development as proposed can be expected to negatively impact the property values of those who just purchased homes in Spurwing Heights. If true, this impact alone would be a significant adverse impact to the existing neighborhood. Perhaps a 55+ retirement community with some commercial space within walking distance that can enhance the community would be a much better option for this property for this reason alone.
