Notes:
1) A ten (10) foot wide Permanent Public Utilities, Property Drainage, and Irrigation Easement is
hereby designated along all lot lines common to a Public Right -of -Way and along all rear lot
lines. A five (5) foot wide Irrigation, Public Utilities and Property Drainage Easement is hereby
designated along each side of interior lot lines as shown. All buildable lots in Block 3 shall have
no side yard easement along the common lot line.
2) Portions of Lot 10, Block 2, Lots 1, 2, and 25, Block 3, and Lot 11, Block 5, as shown, are
servient to and contain the ACHD Storm Water Drainage System. These lots are encumbered by
that certain Master Perpetual Storm Water Drainage Easement recorded on June 1, 2004 as
Instrument No. 104068411, Official Records of Ada County, and incorporated herein by this
reference as if set forth in full (The "Master Easement"). The Master Easement and the Storm
Water Drainage System are dedicated to ACHD pursuant to Section 40-2302 Idaho Code. The
Master Easement is for the Operation and Maintenance of the Storm Water Drainage System.
3) Any Re -Subdivision of this Plat shall be in compliance with the most recently approved
Subdivision Standards of the City of Meridian.
4) Lots 1 and 5, Block 1; Lots 1 and 10, Block 2; Lot 1, Block 3; Lots 1 and 5, Block 4; Lots 1
and 11, Block 5; and Lot 1, Block 6, are Common lots which shall be owned and maintained by
the Woodburn Homeowner's Association. These lots are non -buildable lots.
5) This development recognizes Idaho Code Section 22-4503, Right to Farm Act, which states:
"No Agricultural Operation or Appurtenance to it shall be or become a nuisance, private or
public, by any changed conditions in or about the surrounding Nonagricultural Activities after
the same has been in operation for more than One (1) year, when the Operation was not a
nuisance at the time the Operation began; Provided that the Provisions of this Section shall
not apply whenever a nuisance results from the improper or negligent Operation of any
Agricultural Operation or Appurtenance to it."
6) Maintenance of any irrigation or drainage pipe or ditch crossing a lot is the responsibility of the
lot owner unless such responsibility is assumed by an Irrigation/Drainage District. Irrigation
water has been provided by Settlers Irrigation District, in compliance with Idaho Code Section
31-3805(b). Lots within this subdivision are entitled to irrigation water rights, and will be
obligated for assessment from Settlers Irrigation District.
7) The bottom elevation of all structural footings shall be set a minimum of 12-inches above the
highest established normal Ground Water Elevation.
8) Other than the access points that have specifically been approved with this application, direct
lot access to N. Venable Ave. is prohibited.
9) Fencing on the common lot line of Lot 1, Block 3, shall be restricted to four foot open fence
per City of Meridian requirements.
10) Building setbacks and dimensional standards in this subdivision shall be in compliance with Title
11 of Meridian City Code.
11) Lots 3 through 12, and lots 15 through 24, Block 3 are subject to a 20 foot by 20 foot
common driveway easement as shown, 10 (ten) foot off each side of common lot lines.
12) Lot 1, Block 3, and Lot 11, Block 5, have a 10 (ten) foot wide Gravity Irrigation Easement, as
shown, for the benefit of Nampa Meridian Irrigation District for operation and maintenance of
the Finch Lateral.
