With regard to the referenced “conditions” information (reattached) and Mari Hill’s DA concern (2) what are your
thoughts?
- Do you agree with the requested changes?
In regard to deletion of condition #1a, which states, “The buildings in the retail/professional office area
shown on the conceptual development plan shall be arranged to create some form of common, usable
area, such as a plaza or green space as desired in Mixed Use designated areas as set forth in the
Comprehensive Plan (see pg. 25),”
while we recognize there is a City park & YMCA nearby, the intent of the provision is for a common
usable area to be provided in the commercial area with the commercial buildings surrounding the area –
therefore, Staff does not support this change.
In regard to deletion of conditions #2b, #3c, #10a and #12 pertaining to the requirement of a 10’
pathway & associated easement along Eagle & Amity Rds., Park’s is considering this request – at the
very least, I believe they wanted an easement in case they want to expand the existing walkway at a
later date.
In regard to the addition of language to condition #13 that would allow an exception for a building
permit to be issued for the community center prior to the private streets being approved, that is a code
requirement (UDC 11-3F-3B.5) that I can’t waive – you could request alternative compliance to this
standards as set forth in UDC 11-5B-5. Is it really an issue? You only have to obtain final approval of the
private streets, not construct them.
(Note: Your reference to #2a on pg. 4 of your response is incorrect, it should be #2b)
- What will your staff report to Council look like? The Commission recommendation to Council will include a
summary of the Commission hearing on pg. 17 (as typical) and includes your requested changes in the

“outstanding items for Council” and Staff’s response to your request. It also includes information on the
Alternative Compliance application you submitted for parking and the updated landscape plans.
- When will it be available for our review? Soon
